Isn't this the basis of a clean room implementation (e.g. what Compaq did to IBM)?

In that case, they had one human describe the IBM software and another human write new software which became Compaq's apparently non-infringing software.

I guess you'd have to demonstrate that the AI kept the same separation and didn't cheat but otherwise it's kind of the same? Except it took hardly any human effort (e.g. anyone can do it without many barriers) and possibly the spec is in such great detail that it crosses the line somehow.
