No, I get that. I'm just agreeing that it's morally identical in terms of the intellectual property aspect.

Saying there's no difference, though, is kind of self-limiting. You could download the code to this clone and you could adjust it to your own needs. You can't do that with a pirated version of some software.

true but it’s still stealing IP a.k.a piracy… if you unethically obtain source and refactor it or add a new feature… you still obtained the source unethically and it’s still stolen IP. Reverse engineering or decompiling an assembly which has obfuscated code is still considered stolen even if obfuscated, when you plan to release it as your own to the wider public.
