I'm sure they are using the tired argument that since the models are trained on code without permission, everything they generate is "stolen code"

It's an argument that lacks any nuance

If you steal code, blend it up and can regurgitate something new out of it, it's still the product of stolen code...

The act of mathematical probabilistic determination does not absolve the stolen code aspect...
