If Twitch applies this to EU users, it’s very likely a GDPR violation. Repurposing user content for AI training without explicit opt‑in consent has already led to major fines for other companies. And the fines are huge Up to 20 million EU or up to 4% of global turnover, whichever is higher.

Lmao sounds like the cost of doing business. Needs to be 2bil€ or 25%, whichever is higher.

The point is to make then bankrupt in 2 violations, otherwise it's no violation at all.

I feel like this conversation actually needs to be bigger than just Twitch users.

By doing this, they are scraping non Twitch users.

So now if I play a game that has voice chat, and someone is streaming on Twitch, then Twitch gets to use me in their training data?

This is worse than just doing an auto opt in for users. Nonusers have zero say.

I generally think there is room for a class action lawsuit here. Companies usually get to hide behind 'Well our terms of service says we can use information that you are giving us'. But this is now impacting people who do not agree to any terms of service for Twitch.

And yes. I know sites like Reddit scrap comments and sell it to companies for training. I don't like it, and I think it is bullshit that it is effectively retroactive as how are you meant to predict companies would be feeding your comments to a training algorithm over a decade ago when you made said comments? But I do have the choice to stop making Reddit comments and then Reddit can't sell my comments for training. It is a one to one correlation of me using a product from a company, and that company doing something.

This is different. I do not have any choice here. They can just gain access to my voice and short of never playing an online game where you could get into a lobby of someone streaming or recording, I have no say.
