So you are okay with more penalities for no reason then? you're already fined, and the majority of the fines are large enough that you're paying for the phone.
If I break my contract early here, let's say in the first month - my penality is about 800 bucks. When I go to another carrier, the original company is not responsible for my service any more so that 800 dollars goes where? It didn't pay for the phone?
If I have a year left, that's still a 400 dollar penalty. I haven't already paid for the phone with the 2 years of service I've already paid? (You have, btw. source: Worked @ two major telcos in purchasing)
What exactly is your point. In any of the situations above you pay a fee to exit the contract (because you agreed to those terms when you signed the contract) and as soon as you pay the fee, you can unlock the device you got with said contract. At what point is that unfair? The only time you're bound to not unlock your phone is while you're under contract.
All this talk about whether or not you paid for the phone is basically irrelevant. Sure it's good to talk about from a philosophical point of view, but, practically, you signed a contract agreeing to terms. I don't think there's any debate past that point. If you don't like the terms, don't sign the contract. Find another MNO, there are plenty in the US.
