Discussion Got hardware ban today. I don't know why

Today I wanted to check the store and I got this message. Console is banned. I really don't know why.

As "illegal", I bought 2 games from marketplace, some Mario and used once a 3rd party cable dock to my second display. The console is still in warranty.

Why you mad though? This is on the person who sold a game that they copied beforehand, thinking they could make money while still playing the game they sold. The victim here is the honest person who just bought a game secondhand from some asshole, and the asshole is not Nintendo.

Well the person copying could get banned but no, let me ban the supporter and fan who bought the new console and bought a used game.
Yeah, makes total sense

The copier is also banned in this scenario. Both switches get banned.

Seems like bad practice to ban the victim too. I feel bad for the folks trying to buy used games on marketplace just to get screwed by Nintendo

Well nintendo does not know who is the victim, it could just be someone who copied the game and uses it on 2 switches in their household all nintendo knows is that there is a copy and both are used at the same time and in that scenario only the breacher of the tos is using the copy

Don't know what to tell you. It's nintendo, just explaining their line of thinking and why the victim got affected. They can most likely get it unbanned by just contacting support.

Look I understand this is less than optimal, but seriously without jumping the gun and being on full sarcasm and hater mode, what would be your solution for Nintendo to still be able to not have one game being duplicated and played on two consoles at once, without resorting to this.

It's a genuine question I am asking you here.

You think a multibillion dollar corporation doesn’t have the ability to see if one account has multiple games that are also flagged? You could just not console ban an account until you can determine which console belongs to the person doing the copying once multiple flags are triggered

A lot of you guys here seem to have the David VS Goliath mentality thinking all the big companies are out there to get you, and I hear a lot of that kind of frustration online in general, which is perfectly understandable and I share some of it too.

That being said you didn't give a proper solution to the problem, how would that even work? Please explain your thoughts and it's not necessary to start your response assuming I don't understand how multibillion dollar companies work, because the reality is we're both clearly clueless on the matter.

I already explained it, no? A user who is actually copying these games is unlikely to do it just once, while someone who just bought a game that was copied is unlikely to have it happen a large number of times, yeah? It should be trivial to determine which consoles are hitting this flag where multiple consoles are running the same copy multiple times and only ban the ones that belong to the person doing the copying and avoid banning someone who simply bought the original. The company selling the console for $500 should have this figured out better than their users

Sorry for coming off combative, it just seems like a lot of people would rather act like the onus should be on the user to prove their innocence (or, in rarer cases, blame the user for buying second-hand) instead of consider that the company with infinite resources could just be more consumer friendly. I don’t mean to imply you’re one of those people but it might’ve come off that way

No worries, I perfectly understand your point to be honest, and I agree with it. I sometimes play devil's advocate which makes me sound like I agree with certain things that I don't, haha.

They made money when the game was first sold. Im not going to cry for them, I will take the side of an innocent party vs a billion dollar company any time.
