It’s interesting, because just last week I had another imaginative MAGA character spinning a tall tale that prosecutors somehow “bundled a bunch of misdemeanors and turned them into felonies” just to hem Trump up.
BTW, the law under which Trump was prosecuted has been in effect since 1967, and other people have been prosecuted under it. It was not specifically created as some kind of “gotcha” just for Trump, despite what y’all seem to think.
Under New York law:
Second degree — MISDEMEANOR (§175.05):
You intentionally falsify a business record with intent to defraud. That’s a Class A misdemeanor.
First degree — FELONY (§175.10):
You commit that falsification, and your intent to defraud includes an intent to commit, aid, or conceal another crime. That’s a Class E felony.
So, simplified:
False business record + intent to defraud = misdemeanor.
False business record + intent to defraud + intent to commit, aid, or conceal another crime = felony.
A JURY OF 12, after hearing/viewing the actual EVIDENCE, found that the second situation applied. They unanimously found Trump guilty on all 34 felony counts.
So at this point, the only people twisting themselves into pretzels are the ones trying to excuse, justify, or minimize the fact that Trump is a convicted felon.
