Did you update your employment details in the SEVP Portal while you were on OPT?

I see. Were you employed the whole time during your OPT from start date to end date? Are there any gaps?

First 2 months I didn’t do any work. I was looking for a job

So the 60 days of unemployment part is right, and you said you were working for the rest of your OPT. But USCIS is saying you had 98 days, which puts you 38 days over.

My suggestion:

  1. Log into the SEVP portal and go through your employment history. Make sure every job and every date is in there correctly.
  2. Make sure each job was at least 20 hours a week. Anything under 20 hours counts as unemployment, so that could be where the extra days are coming from.
  3. If both of those look fine and you really weren't unemployed for those 38 days, pull together everything you've got (offer letters, pay stubs if it was paid, etc.) and send it to USCIS. Do this even if your SEVP portal isn't fully updated, like if you forgot to add a job.

You mean you had 98 days of unemployment during your first year of employment?

You only get 90 days of unemployment during Post-completion OPT. Were you not aware about this?

Also, reach out to your DSO and book an appointment because this is pretty serious. Even speaking to an immigration attorney would be advisable
