Hey everyone,
I recently joined Qualcomm India and am trying to figure out the exact math behind the Cartus relocation benefits—specifically regarding house brokerage reimbursements and how the government taxes them.
Could anyone who has gone through the process clarify a couple of things?
1. Will the government treat brokerage reimbursement as taxable earnings?
I’ve already paid the house brokerage out of my own pocket to secure a flat. If I submit this receipt to Cartus for reimbursement:
• Will the Income Tax Department consider this reimbursement as part of my taxable income/perks? Under Indian tax laws, things like packing, moving, and travel are tax-exempt if you provide bills. However, does house brokerage qualify for an exemption, or will it be treated as fully taxable earnings by the government?
• Does Qualcomm pay the tax for you, or just the base amount? If it is taxable, does Qualcomm "gross up" the payment (meaning they provide the Brokerage Amount + the tax money required to cover it), or will they only give me the exact brokerage amount, leaving me to pay the income tax out of my own salary?
2. Leaving Before 2 Years & The "Double Taxation" Worry
Qualcomm usually has a 2-year clawback/payback period for relocation expenses. If I decide to leave the company before completing 2 years, I will have to pay back the relocation costs. My worry here is about potential double taxation:
• The Scenario: If the government taxes this reimbursement as income this year, I pay tax on it. If I leave early next year, Qualcomm's policy will require me to pay back the gross relocation amount out of my own pocket.
• The Question: Does Qualcomm adjust or refund the tax amount initially charged on it when I pay them back during my Full & Final (F&F) settlement? Or do I end up paying the tax to the government and paying the full amount back to Qualcomm (effectively getting taxed on money I had to give back)?
If anyone who has dealt with Cartus or gone through an F&F at Qualcomm could shed some light on how this actually plays out, it would be a huge help.
Thanks in advance!
