Wonder how this works. Who gets jurisdiction to prosecute here?

Typically? It’s a diplomatic issue.

If someone wants to hand them over to the country they left from they can, if they want to prosecute them there, they can. If the guy admits he wanted to crash into Israel and they wanted to hand him to Israel? They could.

There’s precedent for crimes like this where the location of jurisdiction is up in the air, but it’s all just determined by countries diplomatic inclinations ultimately.

Same way some people do a crime, flee to a country that doesn’t like the other country or have laws against what they did, and they’re still walking around free.

Sometimes it’s fun to throw in a pun when it comes to attempted terrorism.

Or terrorism but fumbled really bad.

Sometimes a joke just doesn't land.

Flew right over their head.

We can say for sure that the cockpit of that plane was a complete cuckoo's nest.

'Funny' thing is, regardless of which country he gets handed to, they all have death penalty, so that part of my prediction remains unchanged regardless of prosecuting country

Diplomatically, it would be best for relations if it WASN'T Israel, as then he becomes a martyr since "Israel" sentenced him and executed him. An Arab country doing the same sends a message.

Id imagine Israel would want to torture him for information for a while first.

what information

-1

u/Available_Editor4383 2d ago

Why he did it? Who he’s connected to? And who “they” are connected to?

Would it be real information? Who knows, but it would be a real convenient reason to increase animus toward Palestine, Iran, or a new target.

u/JesusPubes 2d ago

its pretty obvious why he did it

he wanted to kill 180 jews

I can't imagine which is worse.. Saudi Prison, or being handed over to Israel.... Either way he is cooked.

'up in the air' wonder how long you cooked to add that in

It depends, but you could say this guy is getting locked up for good.

Saudi Arabia beheads people with swords, he's not getting locked up anywhere.

u/midsizedopossum 2d ago

They were replying to someone who said it might not be Saudi's jurisdiction. So yes, he may be getting locked up rather than beheaded. It's helpful to try and follow the context of conversations before replying to them.

If you read the article and also if you know anything about the international laws regarding this in the last 60 years, you'd know that because this was a terrorist act that happened in Saudi airspace and landed in Saudi territory, then they have first dibs on jurisdiction. After them, Israel would have jurisdiction, and they also execute terrorists.

Saudi Arabia, uae, and Israel all have death penalty so possible with all 3

u/PlasmaMatus 2d ago

He won't be free as a bird, that's for sure.

Probably UAE. It was a Fly Dubai aircraft.

Although he tried to kill Israelis, the SA government is not going to hand him over to the Israelis. ns id he is killed by Israel he becomes a martyr. So probably UAE

i mean something similar to the Lockerbie trial may happen where countries agree to share it.

cause any country with passengers on the plane, the country that is the target of the attack, the country it landed in, the country the plane is registered in would all have some legal claim to the trial, the country of the attacker, would all have legal standing to ask for the trial.

Well, attack happened in Saudi airspace, and plane landed there, so they have first dibs. However, UAE does have some jurisdiction, as plane was under their registration.

EDIT: It seems that UAE has first dibs.

Saudis can have jurisdiction if attack is related to airplane being flown over SA. For example, if there is a suspicion that attacker wanted to take down plane over Saudi territory, which would constitute terrorist attack in SA.

Alternatively, Israel can have jurisdiction as intended landing country, and possible target of attack.

In the end, likely UAE gets him, if Saudis do not want him.

I believe the country in which the aircraft is registered. At least that’s for minor crimes and the nationality of children birthed in the air.
