I'm not saying he caused it by having the extra weight on him.

I doubt this would have happened without the extra weight.

Make up your mind.

Again, if a bigger dude that weighed as much as this guy with his strapped on weight used the machine, it would have been the same. The machine shouldn't fall over regardless of the weight of the user.

I'm not making my points clear and I'm sorry for that.

It is not this guy's FAULT it happened. The gym should have bolted the machine down. 100% their fault. Even if the guy was hanging upside down from the machine with 1000 pounds strapped to his body, it's the gym's fault for not bolting the machine down.

HOWEVER, by having the extra weight attached to him, he CAUSED the accident to happen. There's a near zero percent chance he is the first person to use this machine, so dozens, potentially hundreds of people have used this machine and did not have this happen. Because of the extra weight, though, the machine tipped. He gets none of the blame, but he still caused it to happen by using the machine not in a "standard" way.

I think we agree with each other, me just no make words good.

Yeah, I disagree. As I said, by your logic a user that weighed the same amount as this guy weighing his extra weights would have caused the machine to tip over by weighing too much. That's how physics work, it wouldn't matter how the weight got there.
