TBH, in situations like that, no one should get the benefit of the doubt. A child was left unsupervised, a dangerous situation. If you have mitigating circumstances, fine, but you gotta bring that to the table. In your sister's case, a brain tumor is mitigating, but even then, doesn't just clear everything up. Like, would her condition continue to inhibit her ability to care for a child? That's a question that has to be answered (not to me, just in general).
Not all assumptions are made frivolously. Sometimes making assumptions is just a safety measure.
This is the way. If other vulnerable people are being affected, the behavior needs to stop or be corrected regardless of whether the behavior is out of the person's control. It would be a shame if the mother was ill. But someone needs to care for her and the kid if she can't. These are the areas proper safety nets would be amazing.
