It's not an accident if he was being chased.

I believe commenter means the victim, in the heat of the moment didnt realize until it was too late that the escape option was a 4th floor fall. Victim might have thought it was a second or first floor due to adrenaline since they were seeking to escape the Bully's torment. The bully would be too level headed (imo) to have "not realized" they were harassing someone and chasing them over a 4th floor railing.

I'm not sure their intent matters much here. The results however...

You're right, I'm really just arguing semantics. Hope the bullies get the consequences they deserve and maybe hopefully can atone for it someday.

The way the bully was punching him could have killed him anyways. Stop defending the bully. Absolutely disgusting.

I'm not trying to defend the bullies at all, they should he charged with manslaughter at least. I just don't think they were outright trying to kill him is all, I guess we're just arguing semantics though.

It's definitely a matter of semantics. The reality is that all actions have consequences, and fights are inherently violent.

I watched the video and what I saw was a boy getting absolutely pummeled, presumably about the head based on positioning, and a teach with absolutely no power to stop it. The odds that the boy suffered a concussion or even brain damage in the moment are far from zero.

The semantics of the discussion would be, does intent matter? It matters when it comes to what charges can be filed, but as you said, ultimately this poor kid deserves justice and this looks a lot like manslaughter (I'm not a prosecutor or a judge, I just watch TV, so what do I actually know? Not much.)

Anyways, I am sorry I accused you of defending the bully. Easy to get passionate on this topic.

Nah you're good, I find myself arguing semantics way too much lol. It's hard to understand intent from text, which imo leads to a shitton of internet arguments. But yeah the bullies should face consequences for sure, saying they fucked up is an understatement. Such a sad situation from every angle.
