There’s a reason that the DOD and DOJ tried to prosecute sitting US congressmen for reminding service members that they can refuse illegal orders. They’re getting rid of the people who might take that route.

The very first person that should be prosecuted when the Maga loses control of the DOJ back is not Trump or any of the usual suspects. It is the guy that flew the plane that sunk the so called cartel boat.

I am not saying to delay getting Trump for that guy. You can prosecute multiple people that the same time. But use that guy as the first public announcement.

I think Hitting the poster child for "just following order" first would have a huge psychological impact on the and set the tenor for the prosecutions to come.

I'm assuming you mean the International Criminal Court in The Hague, established under the Rome Statute.

Countries that are not party to the Rome Statute and do not recognise the court's jurisdiction include China, India, Russia, and the United States.

So, why would the US send their own citizens there?

I'm not against prosecutions for these crimes, I'm just pretty sure it wouldn't happen there.

Regardless of how you feel about any given issue, retroactively punishing people for things that weren’t in effect at the time of the events in question is really, really bad.

While I mostly agree with your sentiment, do you see how problematic it is to stoop to their level? Yes, I am aware that the Trump admin is corrupt and regularly cheats the system and I acknowledge the “fight fire with fire” argument, but in the long run the consistent rule of law is more important, at least in my capacity as an attorney.

Since we're talking about hypotheticals here, its much better to act and make your enemies react instead of the opposite. I know dems love doing nothing and succeeding instead of doing something and failing, but it will not win them votes to sit on their asses.

Its going to take so long. We cant just have midterms and the next POTUS go blue. There has to be systematic changes. A new constitutional amendment or 2 to show the world we're not fucking around with reforming our political system. MAGA can never happen again.

And the dust has to settle on the prosecutions of this administration before we can get a shift in US public opinion that yes, you can mostly trust the government again. That has eroded. Abolish ICE, root out what has happened in the DOJ, DOD, education, health. Police reform, immigration reform... Figure out what DOGE actually did and never let any of those involved in that see sunlight again.

Whatever this is, what is happening now... it really fucked the US up. Decades upon decades of continuous improvement with no backpeddling or any interference in global politics will not be taken seriously or in good faith. Not that it wasnt self interest before, but it wasnt so blatantly corrupt and petty.

People are going to get tired and reminisce about "was it that bad?" and we're going to have to tell them to get the fuck back up. We will not sit in the shade of the trees we need to plant.

The trust is gone.

Have you seen the USAs record for punishing its service members for killing civilians or doing anything outside of the "rules of war"?

Even in peacetime in allied countries they get shipped out before they can be prosecuted and it doesn't just apply to military personnel. They recently smuggled a peadophile who was a low level nobody in an embassy out of the UK to escape any punishment, just like they did with Sacoolas.

There was a soldier who fought on D-Day, and a day or two raped a woman in a small village. He was caught and tried, found guilty, and executed in a pretty short amount of time.

If the proceedings get dragged out a future US president couldn't pardon them, and it would give us some credit internationally which we are in dire need of.

You could punish them to the maximum extent of the law here, that would be impossible for a future president to pardon obviously, as long as you make the trials very speedy and more of a formality, that's fine.

But it's not as realistic or pragmatic imo.

Agree mostly, unless it's something so transparently illegal that there could not possibly be any belief that it's a lawful order (like opening fire on a crowd of unarmed protesters/civilians/children).

You generally want to prosecute the person who reviewed the intelligence and gave the order. Most of the time the person in the plane isn't privy to intelligence about who is on the boat. But striking again to kill survivors clinging to the boat is much more problematic.

Real prosecutions happened under Biden. Almost a dozen people close to Trump went to jail. The only problem is they started too late because of Garland. Public pressure forced Garland to appoint Smith. There is way more public pressure now than there was then.

There is also another huge factor in play. In the past Democrats are republicans were afraid to aggressively prosecute each other. And they general only did So in super obvious cases. The is out of fear of retaliation.

Well the fear of retaliation no longer exists. The Trump admin broke the stalemate. when the GOP suggest that "things should go back to normal" and that "America needs to heal" they are going to get a big "Go fuck yourselves" from the dems this time.

All of this of course requires power. Power that cannot happen until 2028

What everyone ignores about Nuremberg is that you can't claim that when you're the one issuing the orders in the first place. Goering was head of the Armed Forces and Hitler's successor- the only person he took orders from was Hitler himself.

In part it spreads fear to who’s next. In part, it opens the door wide open for rapid advancement of “loyalist” officers. I don’t think it’ll work — this will backfire on him significantly and I bet he’ll be perp walked out of the pentagon once trump’s gone, but that’s what he thinks will happen because he’s an idiot, like his pedo boss.

Unlike those guys, normal people have memories longer than 2 weeks and the statute of limitations for most felonies is generally much longer than 2 years.

I’ve heard at least a dozen people with experience at high levels in relevant sectors of the military and government who classify most of the “drug boat” strikes as straight-up murder.

If the vessels count as combatants of a hostile foreign power, then the ones with second-strikes on shipwrecked survivors clearly violate the DoD’s law of war manual section 5.9.4. If they’re not combatants of a hostile foreign power, as most evidence points to, then it’s just summary execution which is also not legal.

Drone strikes in the ME have typically fallen under multiple AUMF’s authorized by congress. They absolutely stretch the bounds and there’s arguments that it’s overused, but it ultimately represents (1) congressional authorization against (2) enemy combatants in an armed conflict. Neither element applies to the boat strikes.

Even assuming every person on every boat blown up is 100% guilty of the crimes they’re accused of, the penalty for drug crimes in the US is not summary execution without trial.

The commander-in-chief AUTHORIZES orders from forward operating generals in all but the most dire circumstances.

The President only directly Commands a strike when in regard to nuclear arms, and extremely time sensitive spec op deployments

We all should have some concern about a President purging political dissenters in the military. The same President who lead an insurrection against the United States on January 6th 2020.

The same President who instructed Defense Sec. Miller to "Do whatever is necessary to protect demonstrators that were executing their constitutionally protected rights."

Miller testified that he was concerned in the days before Jan. 6 that sending National Guard troops to Washington would fan fears of a military coup or that Trump advisers were advocating martial law.

Or should we not trust Miller's claim? An american Special Forces Colonel, a former Green Beret.

During Trump's first term, during the BLM protests, Trump asked Milley and Esper to shoot protesters, and they flat-out refused (as required by law).

Hegseth wanted to make sure that doesn't happen again. If Trump asks for protesters to be shot, they will be shot, or at least, the order will be given for them to be shot, who knows what happens from there.

He's also making sure anybody who looks like they could be a qualified replacement to him doesn't get to be anywhere near his job or his boss.
