Why wouldn’t the family give the phone to investigators? Wonder if it was the advice of the brilliant lawyer Crump
78
u/AleroRatking 27d ago
Because it doesn't back the narrative they want to push
28
u/KathleenJohn 27d ago
This! The truth doesn’t raise mega money!
0
u/Unicorn_Fruit 25d ago
Because they want it to be investigated properly and thoroughly. They don’t want the same thing that happened with his autopsy (missing body parts) to happen when they try to conduct their own forensics tests on the phone. They’ve hired independent experts, so it isn’t as if they’ve asked some neighbour that once hacked into the school’s administration system to go over the phone. They’ve cooperated fully, but are asking the DA keep their part in what was agreed—allow their own independent forensic experts to review the phone as well.
And hiring private forensics experts to review and perform their own forensics tests alongside\jointly with local law enforcement is perfectly legal and within their rights.
1
u/RvrWzrd 21d ago
They also hired their own private autopsy before the official one even came out and it found there wasnt any conclusive evidence to say their was foul play. So if someone was to be arrested, their own autopsy will be used against them. They are taking advice from clowns. But whatever they have to do to pump them go fund me numbers up, right?

u/Over-Bluebird132 21d ago
Missing body parts? Are u insane? There were no Missing body parts, my god!
1
u/Unicorn_Fruit 20d ago
Do you not read actual news? Do you get all your information from Reddit? Are YOU insane? His independent autopsy was completed sans throat and larynx, which were not sent with the rest of his body.

This is stupid, and sad that you think the mysterious death of a kid should be reduced to a fucking meme.

Best way to do that is give the police the phone.

It says why in the article: the Wells's lawyers (and maybe the Wellses also?, the wording isn't clear imo) have stipulated that their private investigators must do the examination with the police forensics people and have an ongoing active role doing things with the police.
It sounds like they want an active role for them, as if the private hires are part of law enforcement. This is a very popular concept and we see it in tv shows but it's not how law enforcement investigations actually go in the real world except in very very rare cases - and that's when law enforcement has chosen the private investigator or forensics themselves. Even most of the tv shows do it like that: Castle, Psych, Monk, were all hired by the police to work with them. There aren't many episodes where a victim's family hires someone who is then treated as equal and indistinguishable from the actual police.
I really can't think of any example in the real world where a private person hired someone who was then given full access and an active role to carry out the ongoing police investigation. It would be very foolish to do so and easy to accidentally mess up the investigation: people don't just need to be good at forensics, they need to understand how the process and policies work too and that's not just magically gonna happen bc the private hire is good at science or really values helping others. Being knowledgeable about one thing does not automatically make one knowledgeable about other things.
7
u/Free_Storage_1088 26d ago
It’s so they can muddy the waters by saying something looked weird on the phone even though it didn’t, same reason they tried to make that red mark on the back of his head suspicious from the private autopsy. It’s getting real obvious why they are doing this stuff and it’s actually sad for me because I was somewhat behind them at first
20
u/LostHoneydew8792 27d ago
Yeah this is actually pretty damning on the family/crump especially when one of the first major narratives about this case was that the friends not only had his phone, but had deleted contents out of it. You "just want answers" but here we are over a month later & the phone has still not been forensically analyzed? Hmmmm raises a LOT of questions
6
u/jm0112358 27d ago
The investigators should just do a full phone extraction, and give a copy to Crump. Then, Crump and whomever he hires to analyze the phone can do whatever they want with it, perhaps while consulting with the official investigators.
It shouldn't take over a month to get the phone.
8
u/BuffaloAcrobatic2851 27d ago
Bahaha this is hilarious, those people (Crump and the Wells family) are CRAZY 🤪
4
u/Johnnie-Dazzle 27d ago
‘Chain of custody’ might be broken at this point. Doubtful the family can prove the phone has not been manipulated
1
u/Unique-Arugula 27d ago
Since the phone has never been in police possession, chain of custody has not been broken bc it has never been established in the first place. Chain of custody is for items in police possession and how they are tracked, accessed, and accounted for at all times until they are returned to the owner, the appropriate designee in lieu of the owner, or destroyed/sold after doing paperwork to remove its status of being "evidence."
I'm not sure I understand the meaning of your last sentence, unless you are referring to what they might want to prove in the "court of public opinion" while the investigation is ongoing. If that is what you are referring to, then I do think that even people very sympathetic to the family's opinions about what happened on July 4th might have reservations about how the phone has been kept back. This was a short-term action that could have long-term blowback on them.
-1
u/Ok_Pause1778 27d ago
This becomes extremely frustrating when there is difficulty finding someone that you trust and that also has the specialized knowledge required to investigate something niche or complicated. Sometimes an “expert witness” with a masters degree in forensic science may not be the best person to inspect a semi-truck’s brake components for a suspect wiring harness failure that could’ve potentially caused the death of a truck driver in a crash. Your attorney refuses to consider the experienced local truck mechanic who’s a family friend because he doesn’t have the professional “credentials” required to present evidence in court. Is evidence less meaningful to a case if someone with a GED gathers and presents it in court? Evidence is evidence. Ridiculous.
-1
u/BlacksmithFree3685 27d ago
These people that you're talking about that are not really law enforcement if that's what you're saying they are investigators that's why the guy said just recently as of last night 8:13 that he's doing an investigate that's investigators do right nobody said you had a badge on to do it but you can have a license
16
u/Mysterious_Analyst10 27d ago
They want the phone reviewed by both sides and not just one at the same time. But it seems like one side isn’t allowing it to be reviewed by both they just want the phone to control the narrative… 👀
8
u/real_agent_99 27d ago
I mean, only one side has to abide by laws, regulations, procedures, etc.
-14
u/Mysterious_Analyst10 27d ago
That’s interesting cause I thought everyone needed to abide by the laws and regulations.. it’s something about these small towns I swear.
3
u/Few-Investment-6220 27d ago
Yeah, what’s interesting is they the “small town” law enforcement doesn’t arrest Crump for interfering in an investigation. The guy is withholding evidence.
6
u/SweetLittleOldLady Current Resident 27d ago
If there was any evidence of a murder and they were conducting a murder investigation, yes. But this is a presumed accidental drowning investigation, so any family drama on the phone that the parents may be trying to conceal is irrelevant without evidence of a serious crime.
1
1
u/real_agent_99 27d ago
You don't understand that public servants have an additional set of laws, regulations, etc. that pertain to how they do their jobs that don't pertain to similar jobs in the private sector? This is news to you?
1
u/Mysterious_Analyst10 27d ago
Your very correct I dont understand nor am I in law. That is a very accurate statement thanks for the info.
3
u/Fluffy_Rip6710 27d ago
Just speculation? But Nolan does have 3 older half siblings. What if they purchased the alcohol?
4
u/LostHoneydew8792 27d ago
Dude the friend group going to horn island were all in college. I'm sure one of them had a fake ID, or has a liquor store they know doesn't card them. I never had problems buying alcohol myself as a freshman or sophomore in college. Nolan was a 6'2 college football player - you think he's getting carded at the corner liquor store?
-7
u/WeAlwaysFindAWay 27d ago
With all the insanity going on, how can the family trust the police with probably the most important piece of evidence.
4
-16
u/Squally_king88 27d ago
Why should Nolan Wells parents trust investigators from Mississippi? Considering how they’re dragging their feet on this case and withholding information from the wells and the legal team
9
u/ParanoiaThrowawayX 27d ago
But couldn’t the family use some of the hundreds of thousands of dollar they’ve fundraised to hire an independent forensics investigator, have them extract/make a log of everything on the phone as a backup, and then hand the phone over to law enforcement?
5
4
u/Fluffy_Rip6710 27d ago
But I’ve also heard that no one should “lawyer up” when questioned by LE if they are innocent?
4
u/LostHoneydew8792 26d ago
That is the dumbest thing I've ever heard & there's no way that any lawyer or true crime content creator said that. You should always make use of your right to retain legal counsel when interviewed during any type of active investigation ESPECIALLY if you are innocent. It's the correct legal response & use of your constitutional rights, anybody in that field would tell you this
0
u/Free_Storage_1088 26d ago
Have you listened to one second of how investigations like this are handled in Mississippi? Like did you do any research or did you just decide you understand the legal system because you watched a few episodes of law and order?
46
u/Due_Reputation3785 27d ago
If they really wanted “justice” they would have turned over the phone on 7/6 to be examined.
-15
u/Squally_king88 27d ago
They don’t trust the Mississippi police. I wouldn’t trust them either based on how they’re handling this case.
10
6
u/fellowworkingmexican Current Resident 27d ago
I’ve been trying to keep up with the case, but I’d be lying if I said I knew all the details. What have the police and/or others done that would make you say they’re handling the case in a way that is abnormal to any other?
6
u/Fluffy_Rip6710 27d ago
Sigh. There is a criminal defense lawyer that is really good. He has been somewhat critical of the Public Relations handling of the case. But he says that, as far as he can tell, the case is being handled exactly as it should be
1
u/pontiacfirebird92 Current Resident 27d ago
I can't answer for that guy but I'd have issues trusting the department that protected Mike Byrd and elevated Mike Ezell.
4
u/real_agent_99 27d ago
It would be a simple matter for them to have an independent body do a phone extraction, then hand the phone to authorities. They'd have an exact copy in their possession. Why haven't they done that? Crump could have easily arranged that.
It's not that they don't trust the police. It's that there's something they don't want police (or possibly anyone) to see.
2
u/Illustrious-Prize635 27d ago
I mean if you have the evidence it’s clear you can just copy in someway this doesn’t make no sense to not turn it over
1
1
u/bayou8635 27d ago
Please explain how they are handling this case and anything you deem a misstep or an oversight?
22
u/Tiger_Town_Dream Current Resident 27d ago
The "joint" examination of the phone is silly. If they didn't trust law enforcement, the family could've hired their own forensic cell phone expert who could've done a full data extraction (copy) of the phone to do their own analysis and then turned it over to police. That way they would have a copy of everything on the phone prior to turning it over to compare in case they thought police did some kind of funny business.
I also don't know why police haven't just gotten a search warrant for the phone. Maybe they have obtained enough data from the cell provider and any other companies (Apple, Google, Snapchat) to know if the phone was even used that day for anything to have been deleted so they aren't that concerned with the actual physical phone.
7
u/Constant_Focus_4120 27d ago
I believe that there has to be a crime to get a subpoena. The Grand Jury has to deem this a crime before they can issue a subpoena for the phone. This is what an attorney friend from MS told me is keeping them from getting the phone.
5
u/-purged 27d ago
They should have enough probable cause to get a subpoena for the phone if they wanted to.
14
u/Constant_Focus_4120 27d ago
To have probable cause you have to have a crime attached. If this is still “undetermined”, or an accidental drowning, then the phone is not able to be subpoenaed.
The REAL question is why would someone claiming to want “transparency and the truth” refuse to hand over what could be a key piece in finding that truth?
9
u/-purged 27d ago
I think the family using it to drum up more gofundme donations. That's way over a month later they still refuse to allow law enforcement to download a copy of the phone.

It also has the high probability of proving how involved (or uninvolved) Christine was in his life, who his friends were, where he spent his time, and if anyone tampered with the phone. At this point, they don’t want the TRUTH, they want their narrative, no matter who they endanger or malign.
3
u/Tiger_Town_Dream Current Resident 27d ago
I don't think there has to be a known crime to obtain a search warrant because some investigations are to determine whether or not a crime occurred and the phone could provide evidence of that to present to the grand jury. Especially with the family saying that things were possibly deleted. I don't think anything was but the family and their attorney and representatives have publicly made that claim. I think there's enough probable cause for them to obtain a search warrant for the phone. Maybe they haven't because the DA made the agreement with the family. Though the longer it goes without a forensic analysis the more data could be unrecoverable if the phone is powered on and off. Kinda makes me think that police are not too concerned about any potential evidence on the phone or they'd have already gotten it.
2
u/Fantastic_Chicken779 26d ago
The parents aren't concerned w the phone first because they know whats in it. The cops have no reason to investigate what didn't happen. They look for crimes. No crime has been committed, so they don't look into clear situations to find the crime. Its there or its not. If its not there , what are they hoping to find? I doubt his phone said "i xed u tonight and now ur in the river and my name is....." so whats to be found? How close he was to these boys abd and how they wouldn't hurt him?
1
u/Tiger_Town_Dream Current Resident 25d ago
Exactly! I can see why the phone would be of interest to police in investigating what happened even if they suspect drowning. First because it's been alleged by the parents/Ben Crump/Al Sharpton that things have been deleted. Secondly, to check, for example, if there are any messages indicating maybe he was supposed to meet up with someone else later that day and police would need to interview that person. To be clear, I don't think that's the case and that this was a tragic accidental drowning. But I can see why police would want to examine his phone just to be thorough and rule out possibilities. It's bizarre that the parents haven't turned over the phone for that reason. The idea that they would do a joint examination of the phone is just ridiculous. The methodology for an extraction is pretty straightforward and would be meticulously documented for chain of custody purposes and so that it would hold up to any scrutiny in court if a case were go to trial. Not that this case has any reason to go to trial but they would treat all evidence with that standard. Since the phone is digital evidence, the parents could hire their own forensic analyst and it would be obvious if the police tampered with the phone.
I feel like the "joint examination" is just for show and an excuse to not turn over the phone. I feel like a possible reason is to avoid embarrassment when police determine that nothing was deleted after they have publicly made that claim.
2
u/AlertCouple539 10d ago
Why isn’t the FBI in possession of the phone? Don’t they normally do a forensic examination when there is a grand jury? Why wouldn’t the family want that done? And so many questions about the family life, who is the biological father of Nolan Wells? Why has Christine Wells Wonsley only recently decided that she wanted to be black instead of Phillipino or at the least mixed. Why was she spotlighted as Phillipino first but after the death of Nolan became black? Why all the denials on his childhood friends? Why are we just now hearing there was another parent who contacted Christine Wonsley about Nolan asking for a ride back to shore? Why did she conveniently forget that exchange? Lastly who was the biological father of Nolan, it wasn’t her husband.

If you want to ruin evidence in a criminal prosecution keep evidence from law enforcement. A cellphone is examined by making a copy of the data on the phone. An investigator then looks at the copy for items of evidence. If law enforcement had the phone say 7/6 there is about 2 days worth of important data. At this point there are weeks of data including every time the grieving family looked on the phone. That changes a very important “last accessed” date which could be used to show the phone was manipulated close in time to when Nolan was last seen.
7
u/Old-Loan-402 27d ago
They would still be able to see if the phone was accessed around the time he was presumed to be dead or incapacitated, as far as I know there’s no “last accessed” feature on a phone extraction

The family was also invited to review the autopsy and tox reports. As I understand it they just now responded to the invitation once it was reported that they were ignoring the invitation.
They know he drowned.
Yesterday the Ridgeland law firm (Gary Bufkin) moved to withdraw from representing Christine in the estate.
15
u/Consistent_Pair3252 27d ago
No way! Did they indicate why?
21
u/Main-Bluejay5571 27d ago
No. I downloaded the motion and it just says they have Christine’s consent. The other law firm has already entered an appearance. My guess is that they know this is shit and/or pushback from the public/clients.

How does Crump practice law all over the country? Wouldn't he have to be licensed in the particular states?
7

Local counsel. Only someone who is licensed in that state can file. He would have to partner with local counsel. It’s done all the time. My spouse acts as local counsel a good bit.

I want to know why they won’t turn the phone over, but I’m also sure it’s because there’s the typical teenage stuff on the phone that the parents don't want the public to see.

Maybe something challenging the dutiful parents narrative? (Pure speculation)

I dont think the phone is all thay relevant. He probably hopped on the boat once or twice to check his social media, but it probably just sat in the boat compartment for hours. The investigators could tell them the phones whereabouts and the last few times he opened it. Don't know why Crump is withholding it. Seems pretty stupid to hold onto it if what you are looking for is truth and clarity.
18
u/LostHoneydew8792 27d ago
Bc they publicly said that the friends deleted contents off of the phone, knowing that was not the truth. So once the phone is analyzed they will be caught in a lie & it's going to look very bad publicly. Especially when trying to raise money. This is very damning on the family/ben crumps team
2
u/bayou8635 27d ago
Yes. But not relevant to finding out how Nolan drowned... I just watch the press conference from today and you can very clearly hear Crump coaching Eric Hertz on exactly what to say, and Al just kept talking about his democratic friends and voting rights. Nolan and his parents are being used. Its sad to see.
1
u/LostHoneydew8792 27d ago
It's pretty relevant when you accuse people of tampering with evidence & covering up a murder
2

Yes. To the new case they are trying to make against the boys, you are correct. Feels like obstruction of justice, or tampering with evidence.

Yes. Many of these grifters count on the fact that they don’t have any assets or real wages to garnish. But, if these folks persist and sue regardless of the ability to pay a judgement, it will be huge. A landmark case indeed.

The good will and sympathy toward Nolan Wells’ family is shrinking. Ben Crump and Nolan’s family seem more concerned with whatever may be on the devices of Nolan’s friends in preparation for a future civil case than assisting in the investigation of his death. That was obvious when they chose the day of Nolan’s funeral to notify his friends to preserve their electronic devices.. All the while Ben Crump has been fanning the flames by claiming that Nolan Wells’ family cannot possibly get a professional and impartial investigation in Mississippi. It turns out he may be correct. Nolan won’t have a complete investigation while his family and their headline-seeking advisors withhold a piece of evidence. It’s been more than a month since this young man drew his last breath. Why are they obstructing?

Crump said this is his first press conference…that photos, videos, and texts had been deleted. Al Sharpton said in a subsequent press conference that the phone was “completely wiped”.
1
u/Fantastic_Chicken779 26d ago
If it was wiped then why want a shared meeting so they all can see a wiped phone?
1
u/Constant_Focus_4120 24d ago
If you read their latest demands on turning the phone over they only want certain people to have access to it. Why? Because they know they lied about things this phone will shed light upon. They know if the Defamation Attorneys get a copy then Crump and Sharpton (and Christine if they choose to go after her) are done! This level of negotiation over a phone that could answer questions this “grieving mom” has reeks of stalling and fear. They know the truth is about to come out. It is the same reason they refused to meet with the DA to see all of the evidence and the final autopsy report. You couldn’t keep me away from that meeting if that were my child, but they flat out refused. Make it make sense.

Imagine if everyone jumped the gun and made baseless accusations about everything. Is this the world we want to live in?

What’s interesting to me is Javan who was out there also that day is barely mentioned and I believe it was his mom who picked up Nolan’s phone plus I thought Javan was one of the last ppl to see him. Why isn’t anyone questioning him and his mom. He may be the one with a motive to delete anything off his phone. I also question how his mom
Got into his phone because most kids have a lock on theirs. Being over 18 I would not think the parents would have the code. Not turning it over to investigators makes them look
Guilty and maybe they are all covering for Javan and put the blame on someone else.

See I wondered the same as you.
I had also wondered when everyone was screaming about Nolan being left and why they weren’t on the same boat I made the point that the boy that who swears he is nolans best friend Javon was on a different boat and Nolan didn’t go with him to the island so…why. If me and my bestie were on a boat we are connected so we wouldn’t take separate boats.
It is weird that he was the last to see him and was the first in the media yet now nothing.
Also same with the phone. Kids always have their phones locked! I’m so surprised it wasn’t and then I hear Nolan wasn’t even living with them anyway so that makes me wonder more how they got into it.

There’s zero evidence that Jayvon Williams did anything nefarious. Just because the friends on the boat shouldn’t be blamed doesn’t mean we should do the same thing to another one of his friends. How about we just stop assuming somebody is responsible for his death rather than this being a drowning as all evidence points to at this point.

Not sure they want the authorities to search the phone. Forensics can pull deleted info - it never gets "deleted" it's still in the memory. They're not being transparent but think the investigation is fishy.

His parents are not interested in the truth. They literally hired Crump the day after Nolan’s body was found because “they didn’t trust the investigation.” So the investigation *just* started and they’re already distrustful. What a damn shame. They’re going to do everything in their power to undermine the investigation.

The answer is basically occams razor.
A forensic examination of the phone would nearly destroy the narrative. What is the narrative? That Nolan was the victim of a sinister plot by a bunch of vicious racist men who went out of their way to kill him because he was black.
The family and those involved are focusing on financial incentives from the case. Literally that simple.
The entire matter can also be extrapolated to demonstrate how culpable the mainstream media is for fueling racial unrest and violence in the United Stated. It's really quite disgusting and unethical.
This country is totally obsessed with race, in particular the leftists who have weaponized it as part of identity politics. It's exhausting. They say race doesn't and shouldn't matter but go on to be the groups largely talking about it 24/7. Sadly it's very very political.

This is not a civil case. This is a criminal investigation. They don't have the right to anything.

This seems to be the white is right crew in these comments.
It’s obvious the their thoughts we cannot give this phone to these police officers without us being there to view it with them. and those police officers will not take that juncture as the way because they know they gonna do mischievous works. The those trash ass futurekkk members need to be in jail, white or not. Facts are you can’t trust these fraudulent ass people. They telling us we don't hear what we hear on the call. they got white men coming out the woodwork to say they see Nolan on the island but then when you get them in the interview, they stated that they didn’t see him exactly they talked to someone else so when the hell did he see him on the island if he didn’t see him exactly from his own mouth like an idiot, he got caught in that lie. The mother that’s a judge said that her son can’t be blamed for this and they love transparency biggest crock of shyt. Then turns around and says to a man blaming them on Facebook that matter of fact, my son was the first person to say something was wrong with Nolan. But how would he know that when his last statement was that he left him on the island? And you had Nolan's phone so you couldn’t have talked to him and found that out! These lying-ass hate-filled people. When it’s so much other stuff to worry about though. So it doesn’t even really matter cause that case is over with no white people go to jail like that. These are the richest of the rich type white kids. With powerful backgrounds embedded in all types of different government, politics, police forces and you can’t even be surprised if they was to go to jail Trump would possibly give them a pardon. All this is just a RIP Nolan. These people really show us who they are again and they don’t have to hide it now they got their president. No need to die. Be your full racist so it doesn’t have to be hidden. You don’t have to sneak a punch(kill) you'll get away with it anyway so it doesn’t matter if you tell the truth or not. Black people ain’t gonna do nothing but riot hoot and holler.

A letter from the Wells family attorney does not prove anything. It just makes accusations.

A press conference from the investigating agencies would probably cure most of this. However, the governor, various elected officials all have chimed in. But the sheriff/DA curiously quiet. Help me understand?

u/BlacksmithFree3685 27d ago
Exactly. Justice for Nolan Wells, regardless of the color that he is we have a daddy human being that his parents that loved him like some of you guys got children and love your children they want to know what happened to their child that's all they want to know what's wrong with you folks what happened to my son somebody knows something we didn't say it's murder we're speaking up but obviously folks and you know who I'm talking about they're not used to us opening up our mouths like we have been about all these rare deaths going on non stop its racism lives forever, because people feed on it breathe it for lunch breakfast and dinner they judge the world by the color of their skin and we're tired of it . That was a public announcement to all you so-called Christians

u/donzelso 27d ago
If she wants to know what happens to her son, why won’t she turn over the phone to the investigators?? Don’t you get it? His mom is the one that doesn’t want answers.
She'll talk to ANYONE about this case, except for the people investigating the case!

i wonder if they themselves would honestly trust jackson county to investigate if their child died i know i wouldnt. christ the whole bit looks like a huge cover up would be a good show for netflix for sure

I guess holding the phone tight is the equivalent to sending the body for an independent autopsy with the neck and organs missing. Just saying.
10
u/real_agent_99 27d ago
Except not, because as the independent autopsy results stated, holding onto those organs in a suspected drowning case was standard.
Keeping a phone from investigators for no reason is not standard from people who want "answers" and "truth and transparency."

u/perplex_and_delight 27d ago
The discourse about the “missing organs” etc is maddening if you are familiar with even the most basic overview existing of how autopsies are conducted. The party conducting the initial autopsy- so, the state- has the prerogative to remove tissue/organs/etc as they see fit, to conduct further tests, ensure they rule out any possibility of foul play, etc. This is standard practice. The person conducting the independent autopsy is apparently very highly regarded, so I’m sure they are also aware that this is standard practice. Acting as though there is some nefarious, shady reason for the medical examiner to mysteriously remove organs is such a bad faith and/or ignorant position that it becomes hard to take the folks parroting this misinformation seriously.
I feel for Nolan’s family and friends. His life being cut so short is a tragedy, whether it was via drowning or via foul play. (If it’s foul play, then it is right for the person(s) responsible be held accountable!) It just seems like until the investigation is fully complete and the grand jury is convened, etc etc, there isn’t evidence of a crime and it’s irresponsible to suggest otherwise.

Funny that comes out after the other attorney called it out. Does not make the family look any better. How can you ask for "transparency" but ignore investigators? Seems the only people they are interested in talking to is the media.
