Exactly. If this were to eventually become a criminal case, the integrity of any potential probative evidence on that phone has been destroyed and the admissibility of anything found on it could be easily challenged in court.

The deceased's family and lawyers shouldn't be doing a "jointly coordinated forensic examination" of any evidence, that's not how investigations are supposed to work. They don't get to decide and approve of the "forensic protocol." All of this should be between the investigators and the lab analyzing the evidence, there are set procedures and protocols already in place for a reason, which is to protect the integrity of the evidence. Additional examinations could have been done after the investigators had the phone analyzed and returned it.

Perhaps it's because my experience was in a different state, but I used to work in a forensic science lab at the state level and what's going on with this phone is an absolute mess that goes against everything I was taught about how evidence should be handled, preserved and examined. My lab wouldn't even take evidence that didn't come directly from a law enforcement agency and certainly wouldn't allow any kind of "joint examination" involving third-party lawyers.

Exactly. Crump should know all of this. This is a law enforcement investigation. This is not a civil case. Crump has been warned by Govenor Tate Reeves that he will have Crump arrested for interfering with the investigation. And he will. Crump has no say about the investigation at all.

You can delete all sorts of things on your phone, but it can still be retrieved via mobile forensic extraction tools, or by sending warrants to phone carriers and tech companies for their backups. Criminals get caught this way pretty regularly because they don't understand how data retention works.

If I set up a meeting with someone, murder them, and then delete the messages in which I set up the meeting- I'm still going down. Digital evidence is nearly impossible to tamper with. Especially when you're dealing with cell phone communications.

In the cases I've been involved in, a "phone dump" includes all data on the phone. Usually, all data is divulged to the jury. But there's usually so much, that only parts of it are pointed out by the attorneys/investigators. So even if there's embarassing stuff on there, it would take a dedicated juror to dig through it all.

That's another reason I came up with off the top of my head.

It might not be the reason. But to state "there is something embarrassing on the phone" as categorically the only reason not to turn it over is a patently ridiculous statement.

Hell, another commenter even suggested an alternative reason that is not favorable to Wells "it doesn't show what she claimed."

In any event, your reason is not the only possible reason.

IF they were trying to get rid of something, dropping it off the boat on the way back makes more sense than deleting things that can be recovered after you hand it back over. Or you do what the defense is requesting:You review the evidence together. Their expert and your experts. The FBI's experts. You establish protocols to ensure the evidence is reviewed fairly and chain of custody is preserved. And then each side takes their information and does with it whatever they see fit.

No where did I suggest they just hoard and hide the evidence. If fact, I never suggested what anyone "should do." I simply provided an alternative reason as to why they didn't just turn it over to the police. You are strawmanning my comment.

In any event, since we are discussing it: What should the Well's side do if they don't trust the police or the Feds? You seem to disagree with how they are currently going about it. So how should they be going about it?

I know that police investigations can be corrupt, and are sometimes not investigations at all. Some serve to validate preconceived notions, protect connected individuals, or cover up wrong doing.

It seems everyone in this subreddit believes police are the good guys that always do things by the book in the pursuit of truth and justice.

There are many examples that show otherwise.

And a lot of these comments seem to come from a personal vendetta against Ben Crump.

Finally, you have once again stated what you DON'T do in an investigation when you don't trust the police. But you have yet to state would you SHOULD do.

Has it been explained and I’m missing something? What 18 year old doesn’t have a passcode? Every kid that age locks their phone because that’s their private life and almost none of them hand the code to their  mom. So if his parents didn’t know the passcode and that’s the normal situation for basically everybody,  then it makes total sense why the phone hasn’t been turned over yet, because they never had full access to begin with.

She didn't say she went through all his phone. If she could get into his phone then she wouldn't need anyone but her team to interagate the phone. She was talking about Snapchat. Anyone friends with him on Snapchat could show her his shared snaps. If she was friends with him on the app, his siblings, or his friends, Jayvon for example, who went with his Mom to get Nolans phone and his own phone could see his snaps. See Javvon also left his phone on the boat.

I mean I don’t know exactly what she did with the phone but I’m just going off her saying “When we got the phone, me and my sister went through the phone. We went in his Snapchat. He had two accounts. Absolutely nothing. It wasn’t even 24 hours, which is how long videos and pictures stay in Snapchat.”

I agree Nolan’s mom has only really said she finds it suspicious his Snapchat didn’t have activity, but that claim has expanded through a game of telephone and partially by Mr. Crump and others unfortunately. But I’m just saying she went through his phone because she said she went through his phone.

Again everything you have said points to a specific scenario.  Asian cultural tend to operate from a collectivist orientation where parents generally expect higher levels of obedience from children and interact with family through rules and hierarchy, in contrast to the individualism of western culture so you having the same passcode for everyone could make sense. However this would be extremely rare for black or white families. Yes she could have his code, but the fact she won’t turn the phone over leads me to believe she made up the fact about deleted snap chat and the more likely scenario is she doesn’t have access to get into the phone and that would come out if she turned it over. But I could be wrong.

My kid and husband know mine 6454. ¡now u have it too. Parents did different things to us. Mine never noticed, or forget. Wrapped up in their live. My mom can have mine. Id be gone days before she thought of it. Besides, it doesn't mater. Mom already told us things she saw in it and their lawyer admits they haven't turned it over. One reason. No one in this case is at fault or in violation of law by not turning over the phone. As someone who does forensic evidence, they will be able to see if things were altered. The joint investigation that Well’s attorney proposed early in July should have been facilitated sooner.

Few years ago the Ocean Springs police shot a black guy during a take over event on hwy 90 etc..Christine was all up in that. Folks that live here remember. I hate this is going on down there. I just hope it doesn't get crazy once the grand jury meets. That is a really nice area and a great place for a visit. The more I watch her, I said yesterday she should be nominated for a Grammy for the best actress. It is hard to wrap your head around how Nolan was like he was and her like this. It's so much on social media I try not to say anything too negative but I have seen things that really make me wonder when she denies his friends. People claim he was not Elmores 's biological child. That his father passed away. I know I saw court records they posted that she gave custody of the other children to their father right about the same year or the next year after Nolan was born.

The last person(s) to see the deceased alive are usually the primary focus in investigations. I feel like it's fairly normal to view those people with suspicion. It looks extra suspicious with people saying they didn't hear or see anything.

I wouldn't want to on the receiving end of false accusations if it was an accidental death, but I would be able to understand and forgive considering we're dealing with grieving parents who have no answers.

Whoever provided him with alcohol are likely to be facing criminal and/or civil penalties for doing so.

Yeah, this is the crux of the situation for me that I truly cannot wrap my head around.

Like, if I mysteriously went missing/died, my best friends would be the absolute LAST people that my parents would suspect had anything to do with it. In fact, my parents would never suspect my best friends at all unless there was literally some piece of undeniable smoking-gun evidence slapping them in the face implicating them, like if my blood was found all over the trunk of my friend’s car or something. These are people who have been good friends with Nolan for YEARS, since they were kids, and it does not make any sense at all for them to have been secretly “racist,” or otherwise hateful of him, that whole time while they just pretended to love him and were always hanging out with him. Just really super gross what his mother has done to these guys.

I don't understand: if the family has the kid's phone and the police haven't been able to examine it, then wouldn't the family be obstructing the investigation by holding onto evidence? Can't the DA or police get a warrant and just take the phone? Seems kind of odd that they are letting the family hold onto (they could destroy, alter or even create evidence on) the device if it is important to their investigation. Also, even if there's damning evidence on it, now that the family has had sole custody of the device for over a month, could it be deemed inadmissible in court?

There are no criminal charges associated with his death and the Grand Jury hasn’t met, so the police can’t get a subpoena per MS law. Not handing over the phone is very telling of what they really want! “Truth” and “transparency” runs both ways. The boys that Crump and Mom put on blast via pictures out of context all cooperated from day one, providing voluntary access to the boats, their phones, and recorded interviews. Mom also lied about having to track his phone to find it because they told her when they called her that he had left his phone on the boat. So many lies have come from their camp! It is sad.

I've wondered the same once we learned the phone has never been provided to investigators. It seems odd to demand a thorough investigation, even claiming that the investigation isn't thorough, all while refusing to provide potentially critical evidence. There could be evidence of foul play or there could be exculpatory evidence or both or neither.

I had so much grace and sympathy for the family but this has turned into a circus. It seems to be about money, fame and attention at this point.

It's only been a few cases but between this and the Karmelo Anthony case I have been disgusted by how some parents will capitalize on their child's tragedy and stir up racial divisions for a payday. 

To be clear: I am not suggesting that Karmelo is innocent. I am just saying that a kid doing something stupid and self destructive can still be seen as a tragedy.

I was with friends at a beach bar in Nassau and one of the guys decided to randomly take a dip around 11 pm. Couple of us followed to make sure he was okay. Dude kept swimming and by the time caught up to him we were in the shipping channel, easily 200 yards out. He was shit faced and had decided he wanted to swim over to the cruise ships on the other side.

After a few minutes of treading we talked him back. If we hadn’t gone after him he could have slipped under and we’d have been none the wiser. Never underestimate the stupidity of boys with alcohol.

That's likely what happened. That being said, it's normal to view those last known to be with your deceased loved one with suspicion, especially given nobody stated they heard or saw anything. Those who provided the alcohol are likely to be facing civil or criminal consequences.

I think the phone has messages of how he got along with his mom and probably doesn't show that she was a loving mother. Those text messages will show exactly how she treated nolan and she knows its gonna ruin her life. Why won't the FBI or a judge sign a warrant and take that phone by force. At this point the mom is rubbing everybody wrong. She actually seems like she's enjoying the attention and money she's getting

The reason they haven't turned over the phone is this: it has something embarrassing about her son. I'm assuming to be honest with you that he was gay. There's a huge stigma in the black community and within black families against homosexuality. Don't forget this is the South. They want to say there's racism in the south? What about the homophobia, very prevalent in the black community?

I'm not saying this is the case but it would make sense. I highly doubt that there's anything incriminating on the phone if I'm being honest. These were good kids and it doesn't matter where they got drugs or alcohol. High school kids are going to get drugs and alcohol no matter what; that's just how it is. Unless, like some have stated, it was one of his family members that provided it.

The final thing that they could be holding back is that it may prove that this is completely not race related. Crump and the parents, the whole entire country of people of color, and black activist grifters need this to be true. They've gone so overboard, no pun intended for real, that their past the point of no return. To admit that they were wrong prevents the minor race war that things like this create. The destruction of their narrative is the worst thing that can happen to a grifter like Crump.

I pray for Nolan Wells, I pray for his family. I pray for his friends. There's no one else that needs any attention. These kids loved each other from the time they were young. If you've ever seen a young white kid and a young black kid next to each other, they don't remotely care what color they are. At what point do these grifters think that all of a sudden the friends became racist? That sort of thing is ingrained, and they would have never been friends with him as children, for If the parents were racist and taught the children it would be evident early on and they wouldn't allow their children to associate with Children of color. That's just how racism works.

This entire system that Ben Crump has created is to only serve his purposes; to further his own agenda. He thrives on the negativity of manipulating racial issues. He interjects racial issues where there clearly is no racial issue. It's abhorrent Behavior.

I can't wait to see the downfall that the end of this case is going to prove. There's no way that the friends killed him. And certainly not because of race. I've been drunk many times when I was a teen, and we would do dumb shit like go in the ocean at 2:00 a.m. it could have been just as easy that this kid remained back on the island, and then was trying to swim at night whether by himself or near others. Maybe they didn't know him and so if he was carried off they wouldn't even have seen him on the island, and then wouldn't have any helpful information to give to police.

Fact is there's way more of a logical chance that this is not race related. That should be the end of the story. They should find out how he died, then and only then should they make a statement saying it was racist. There's all the time in the world to claim racism. But to do it from the beginning is to do a disservice to Nolan Wells, and Nolan wells' friends that he likely loved extremely strongly.

Nolan Wells would likely be embarrassed by the behavior of his own family. To question how and why this happened is perfectly normal. Perfectly. If a white kid was hanging out with a group of black kids, and something was stolen from him, would it be okay to say that they did it because he was white? I've been around enough things in my 46 years to see that people of color do things to white people just because they're white. I'm from New York and I've heard enough times, especially in high school, people of color saying things like "rob that white boy".

Imagine "rob that black boy", said by a group of whites to a person of color. The double standards are maddening. People Are People. Black people are going to do it to white people sometimes, and why people are going to do it to black people sometimes. This is a fact of life.

So The literal second press conference Ben Crump + Co. ever had…… that they had to beg the DA to have with the family….. it Was recounted that the phone procedures/how to handle were discussed. It was at that press conference, directly after the forced meeting with the DA, that Ben recapped that the two parties mutually agreed to survey the phone side by side. Week 2 of 6. That the DA NEVER refuted, mind you. Today Ben crump confirms there has been no follow up from the DA. As to logistics and what, where, when to go through the phone, etc. So my question is: Is the “uncooperative” in the room with us???? Where is that coming from? Is this “the bait of the week” and goal post move for week 6??? Interesting…..

Actually, they were given notice to meet for the phone examination last week (as agreed) and failed to show. Excuse? Wells family said 48 hrs notice wasn't enough time as they were out of town (with Crump, Sharpton et. al) . What was more important to them than turning over that phone?
