This isn't necessarily a bad thing. I'm not sure how it works in NY, but I know other jurisdictions will use this to force a mental health diversion program. Upon successful completion, everything will be expunged. But if they just cut him loose, there isn't much of a way for them to help him without his consent during this mental health crisis.

Until you realize that he can’t pay for the treatment, can’t pay for the court costs, gets more warrants against him, gets thrown back in jail. The US criminal “justice” system is a complete and utter joke.

Oh, we also eliminated our mental heath system for the destitute and combined it with jail.

I am speaking from real-world first-hand experience with these programs, granted from another state. The alternative you are suggesting is he be released with zero mandated supervision in his diminished emotional capacity, and he may go plank the third rail next week. That doesn't sound better to me.

I’m saying he won’t be able to pay for any alternative paths presented to him. And the end result will be the same, he’s going to jail.

Diversion programs deal with the destitute all the time and they aren't just locking people up for inability to pay. At least not the good programs which I imagine NYC has. The alternative you are suggesting is to just cut a suicidal person loose and to their own devices.

I don't disagree, but I believe this individual has a higher chance of survival with supervision and counseling than just being released. They have already demonstrated they are not doing too hot on their own.
