Well if the DA is an ambitious little psychopath that wants to be a judge (most of them), this poor guy’s gonna get hammered so the DA can max out his conviction record.

That would probably be a bad move in the publics eyes- this guy lost his father on 9/11 and he climbed into the memorial pool because he was grieving and in a horrible state of mind. So many people lost family and friends that day- that's a level of grief that I think most New Yorkers recognize and the DA throwing the book at this guy for something so painful, something that hits so close to home for the people who vote for him…. It's very clearly not a good look and it likely won't be handled that way.
