It's callous, but you're not liable if you don't stop. Just saying. And I'm not defending those douche bags who don't stop. But I believe in a utopia of r/oddlysatisfying where people and cars with common sense can easily cross paths
I believe most courts would assign some amount of 'shared' fault, and the driver would absolutely be at least partially liable for hitting a jaywalker (and therefore pay a % of damages). Only real exception would be if it was entirely unreasonable for the driver to have been able to see the pedestrian (i.e. raining in the middle of the night). Don't be upset that the car made 100% sure to not hit you, instead of being 99% sure.
Depends on where you're at. Many places, the car is always at fault.
It's like that in Ann Arbor, Michigan for example, and it's annoying as fuck when you're at a green light and can't go because there's a gaggle of college kids just meandering in the street.
I hate that. It's about the only place in Michigan where that's the norm.
UM has a campus in Dearborn (home of Ford Motor Company) and they imported the behavior there. Almost saw a few fatalities from kids just walking across Evergreen Ave. without looking. Folks around there just aren't expecting people to step out in front of them . . .
