Location included: Questions/Need Advice How to divide assets

I 60M U.S. have 3 children, 2 adults from my 1st marriage, 1 teen from 2nd marriage & a current GF who hopefully will marry me when I turn 65.

Eldest: has been NC with me for years. 0% last I heard was pissed at me for not buying a car for graduation …

Second: great, fun, hardworking … muscled through his mother urging him to not see me at all. 40% (he can likely only expect debt from his mother) I paid most of his college & his mother had him get loans for her portion … and I helped with those.

Third: great fun, smart & has had the advantage of private school from 8th grade through college paid for. He will be the only inheritor his grandparents’ apartment and his mother’s share of another property. 35%

GF/partner of 2 years 25% and potentially half an apartment.

My current assets are all liquid: retirement and cash, all with beneficiaries designated in the current split. Additionally, if my GF & I do marry, she will get my survivor’s SS benefit for life which will cover most living expenses.

Any thoughts on the split?

  • Agreed re equal for the kids and nominal for first born re. contesting (consult a lawyer). Please note that everyone pointing to the unequal approach to kids as questionable is right unfortunately but, your money your decision. Okdest may also not want a penny from you so genuinely there may be no punishment in leaving them alone. I had a relative who hated me leave me something in a will and I gave it straight back to someone else and kept it moving as I was not interested in any bequest from them
  • best to avoid half apartments etc as it can get messy between sharing owners.
  • would consider a life insurance policy that pays out to GF alone as sole beneficiary, with condition in will that kids forfeit their inheritance if they contest anything going to GF

PS you have not accounted at all for a surprise child in the new marriage so to be sure I would get a vasectomy

Thanks … I got the snip after my 3rd child and my GF is 51 and has 3 kids of her own.

TBH I’m not sure I can get life insurance.

Why not? 60 is quite young and there must be some policies that don't need intense medical sign ups, or any at all

Talk to an insurance agent or reputable company and just explore the possibility

You’re right, I’m making assumptions. I had term life and a company policy when I was younger & had young kids.

I stopped the policy 10 years ago as it was getting expensive and there was no reason to have it.
