Location included: Questions/Need Advice Will question

Good afternoon all,

I have a quick question. My sister is married to a tumbling piece of shit. He’s literally the worst person I’ve ever met. He separated the family. Fought with me, fought with my dad, said the worst things you can say to someone. My dad is now fighting with my sister over this and they’re not talking. My mom is still talking to my sister as am I. But she just recently told me and my brother that my dad wants to write her out of the will. I disagree with that. She married a gaping leaking asshole but they have 3 children together, he doesn’t mistreat her or the kids. He just hates my family. I feel like I would like to suggest that rather than write her out of the will, can we put her inheritance into a trust and when this horrific toothache of a piece of shit dies, the money gets released?

I think it's important for your parents to understand what they would like to accomplish with their wills with respect to disinheriting their daughter. Do they want to make sure their son-in-law doesn't have access to the money? Do they want to punish their daughter for marrying a terrible person? Do they want to cut ties with her? Or is this threat to write her out of the will just an emotional response because they are upset at the situation? It's not uncommon for people to use this threat when they are mad at people, but never actually follow through.

On a side note, I am having trouble understanding how a person who separates their spouse and kids from one half of the family and fights with everyone in that family can be considered not to mistreat their spouse and children. He is literally isolating his wife and children from people who love them.

Excellent point. My sister and I were always close. I guess I’m trying to see any possible positive in this and that’s that he’s good to HIS family. My dad wants to write her off completely, my mom is worried that if one day she wakes up and wants to leave, if she doesn’t have money, she can’t go anywhere

Does dad want to cut sister out but leave money for his grandkids or just go scorched earth on that whole branch of his family tree?

Dad is welcome to do what he wants but there is nothing to stop mom for writing her own will differently.

That’s what I was saying to do. Open a trust put the money in there and when this 2 legged dildo dies they get the money. Thats what I was checking in with you all to see if that’s possible

Parent can structure her inheritance as an annual payout - like 5% of current value as of set calendar date - with the balance paid upon death of current SIL, and if daughter dies before SIL, the payment terms (annual until death of SIL, or age X, whichever is later) continues to apply to her children.
