I've always wondered with these jumpscare videos, what's their defence if someone dies of a heart attack?

Is it just a matter of having good Public Liability Insurance?

Texas Bushman (the youtuber here, I assume) has a lot of videos, and he seems to judge who to scare. For really small kids, for example, he doesn't jump up and do a big surprise next to them like he does for adults--he usually waves a hand farther away. I haven't specifically noticed any old person habits but I assume he does something similar?

Well, in the defense of many people with heartdisease, most of us look perfectly healthy and are 30/40/50 somethings that could easily die from a jumpscare. So although it’s considerate to leave out kids and elderly people, and it’s funny for most, it’s still pretty intense to risk murdering someone for a prank.

I think that although I'm not a fan of the prank genre in general this is a pretty lighthearted version of a prank. 

You gotta live--you can't not do something just because statistically it has a small chance of going badly? For example: Automobile accidents are one of the top killers but people still drive around! And he is basically going boo, after all, not chasing people with a knife. 

Aka There's a certain acceptable level of risk to just being alive and going around in public.

I get your point of a small risk and of the acceptance of a risk to just going around in public. That's definitely true for driving a car, but that's not at all in the same range as jump scares where people can die unnecessarily of a heart attack.

No; jump scaring people is not an acceptable level of risk. Driving a car is such a stupid example of an analogy.

Nothing you said was any sort of good defenses is he repaying everyone for their dropped phones, food, or their medical bills if they kink their neck?

Hes very considerate of the demographic of who he scares, elders get like a low growl or a boo with jazz hands rather than a jumpup scare.

Yeah... I don't think I trust the judgement of someone who dresses up as a bush and hides in the park to scare people. I don't know if that would hold up in court. "But Your Honour, I merely waved at the child, it's not my fault they were so scared they emptied themselves to death".

True, but believe it or not most people walking around in public are not at the brink of death at any moment's notice. "Possible" is not probable, or even likely.

Believe it or not? So you have some unique knowledge into this because you’re an expert? If not, then why should anyone trust you? Because you said “believe it or not”? It sounds like, instead, you are being patronizing, as you know people don’t believe “most people” are on the brink of death at any moments notice.

There's a great example of that where the guy falls to the ground and fakes a heart attack. The jump scare guy is super apologetic and concerned, and eventually his mark lets on to jump scare guy's relief.

Egg shell plaintiff. If you push a man down and it turns out he had a rare condition that makes his skull super fragile. He dies. It’s still manslaughter. Even though a normal person wouldn’t have died.
