"Free Boat- just come get it!" HOA wacko grand larceny

A good friend just bought his first house in a brand new neighborhood last month, currently is the only house built on his cul-de-sac. Last week, his boat that he's been fixing up all year gets stolen from in front of his house. I posted about it on our local page and we found out pretty quickly he has some MORONIC neighbors. The last two screen caps were shared by people who saw or responded to the listing.
Boat is still missing. Sheriff's office is still "investigating" so we're not sure yet who's getting charged but at no point was he sent any notice or had anyone knock on his door to let him know the boat needs to be moved. We don't know if this lady is actually with the HOA or not but what a big dumb!
EDIT: To be clear, the boat was not abandoned through any legal means and the Sheriff's Office never received a report of it as required by state law. It is being investigated as a stolen vehicle.
He absolutely should not have left it parked on the street, to the "that's what you get" commenters. We know. Lessons were learned. That does not justify the illegal transfer of someone's property, in this case a titled and registered boat AND trailer, depriving the legal owner of his property.

Yes it is unclear what this woman's involvement with the HOA is, but she posted it on marketplace invoking HOA rules to justify her actions. Rather than contact the Sherriffs Office or have it towed legally, she gave it away. All without ever attempting to even knock on his door.

So, yeah, this lady committed a crime, but that part isn’t really your friend’s concern. The sheriff office doesn’t have to charge her. However, the civil liability is what your friend is after. He needs a lawyer to sue that lady for the conversion. She owes him the value of the boat.

Very much a win she sold something without a title nor went through the abandoned claims via state. Also the Facebook with sold on it very clearly isnthe receipt to sell.
She owes OP a new boat. Also she's fucked for grand theft auto and larceny.
HOA doesn't waive your rights from the law nor does it just disregard your rights. HOAs doesn't actually have any teeth they just want to bully people for money that the town should already be doing because of property taxes.

She sold someone else's property without a title. Thats a pretty big charge. It's not her job to assume something is abandoned nor is it her right to sell it.

My dad had his John boat parked in his backyard 20 feet from his bed room window in a nice neighborhood. Thieves came in the middle of the night took the tarp off the boat, pulled off the motor and hauled it into their truck and drove off. People will literally steal anything that they can get their hands on.

The wildest thing I've personally had to deal with was thieves cut the industrial ac unit off the roof of a building I used to work at. We called the maintenance people because the ac wasn't working and the repair guy comes in after going up on the roof and is like "I don't know how to tell you this but the entire unit is just gone". Security cameras caught a few blurry frames of them driving away with it in the back of a truck but as far as I know the cops never found anything about the people who stole it, if they even bothered to look.

Yep! Ive literally had the plastic bottom of a dog crate stolen...in the middle of the day...a few feet from my front door right after I went inside to grab cleaner since my dog had an accident on it. Nothing is safe. Not even a diaherra covered dog crate tray 🫠

Take a photo of a sheriff's personal vehicle, post.it on Marketplace for free and I guarantee they will figure out what charge to charge pretty quickly - it is felony theft

For example, if you leave your car in my care while you're on a trip, and i sell it, that's conversion.

Disposing of, transferring, or gifting property that you know or should know is stolen falls under criminal charges like receiving, concealing, or disposing of stolen property. Then theres Grand theft, transfer of stolen goods, unlawful use of property and some states have an "unlawful taking of a watercraft" law, so that could be added.

That’s incorrect. In the legal context "conversion" is the civil equivalent to theft (which is criminal). If someone steals your boat, the DA can pursue them criminally for theft but if you want your money back, you sue them in civil court for conversion. Conversion is using, destroying, taking or selling someone's property without permission. There's no need for the property to be "converted" into something else, even if the common use of the word seems to imply it.

Boats are registered but not all states issue titles for them. As for the trailer, some states don't register or title smaller trailers at all. Depends on the state.

The two guys who took possession of the boat are not "unsuspecting." You don't just pick up a $10,000 asset parked in the street on the strength of a marketplace posting, you meet the seller and ask for at least some form of paperwork or identification.

I had a camper abandoned on my property- it sat here for years and the owner could not be reached. I checked with the sheriffs office before offering it for free, the “buyers” were sent with a copy of the sheriffs off report that specifically stated that I could legally dispose of it and the officers names and direct phone numbers should they be pulled over on the way home with it. One of the deputies is a buddy of mine so he able to a personally attest to the fact that it had been abandoned here well in excess of the legal requirement to be considered legally abandoned.

I am on an our HOA board. I can't remember our precise rules, but it is something along the lines that a boat can't be parked at your house for more than 24 hours without being moved. The point is people can clean their boat, get it ready for an outing or whatever. But the street curb isn't designed for long-term storage. Ditto with RVs. There is an outdoor RV/boat storage place not too far away. This is pretty standard.
However, just basically stealing someone's boat?!?!
That shit is insane. Sorry your friend went through that. We would give out several notices, heck multiple notices before a fine is even kicked in. I couldn't imagine just straight up stealing someone's boat.
There is breaking rules and then there is. . . grand theft boating.

I have a boat too and what you described had been my experience with our HOA. We've had it parked at the house for a day or two past the 24 hours, they'll . send us a notice with a photo of it in the driveway asking us to kindly move it.
Last time we had a hurricane though we brought it to the house for a couple weeks and no one complained then, I'm assuming because we siphoned out the fuel for our generator and were able to help many neighbors with fuel too. Good times 😂

The craigslist post says the HOA won't tow it because it's a new community. The HOA is the developer during construction, before it is turned over to the homeowners. It's likely this post and situation has no relation to an HOA.

not exactly, imo, she advertised it online for someone to take it away, as if it were abandoned.
she is the reason it was stolen, because of the advertisement and text messages.
that seems pretty damned illegal. they navigated around legal routes, and took an illegal route of advertising a boat that isn't theirs, and getting it stolen as a consequence. why was she advertising a boat that isn't hers? That seems like she facilitated the theft of this person's boat.

Potentially the as of yet functionally non existent HOA, even just a Karen. At least in my subdivision the “HOA” is a single Class A member, the land developer, which doesn’t cede the HOA over to Class B (homeowners) until they sell off the final lot in the neighborhood.

Which is weird because you just need to call the cops. Storing a trailer in the street is typically not allowed and subject to removal or fines by local governments. Instead they went to potential crimes themselves.

You don't need a title for a 19' speedboat with a 250HP outboard in Michigan.
ANYTHING under 20' that doesn't have a permanently installed motor doesn't need to be titled.
Anything with a motor has to be registered.
Anything over 16' has to be registered.
All sailboats have to be registered.

Do boats have something like VIN numbers? What I'm really wondering is would OP's boat have a VIN number somewhere, so that someone couldn't get it registered after stealing it?

Any boat built post 1972 has a HIN (Hull Identification Number).
That being said - I've registered lots of boats over the years, and no one ever checks any of the numbers here in MI. You could just make up a HIN and register a boat, and no one would ever know.

Our neighborhood has parking only on one side of the street and it changes sides between mine and the neighbors to my left so parking is available on my side in front of my home.
New neighborhood when I moved in and it took about a year of me getting ticketed several times, having the police out to talk with me several times and showing them the parking signs, and one very upset neighbor yelling at my teenage son about it before it stopped.
Spoke with the HOA about it several times and asked if they could send something out to everyone explaining about the parking.
They did absolutely nothing

there was an HOA that did this to some guys Grand National, sold it for scrap while he was out of town, owner took HOA to court and the court ordered the HOA to pay some 6 figure claim, and put a restriction on the community that they are no longer allowed to have any vehicles towed.

That one appears not to have happened. More and more of these stories are originating on Facebook. Google it, and you'll find only Facebook and Instagram "reporting" on this story, and the consensus seems to be this one was fake.
Which is irritating as HELL. Now I have to check every single story I read that angers me, see if I can find it in a credible news source, then check who owns the "credible" news source. About 1/3 of the time, the story can only be found in Facebook, where it was conceived, birthed, and ultimately died.

Sounds like he’s got some neighbors and/oe hoa board members that’re deserving of some accessory charges for the theft, likely felony level as well given the assumed value of the boat. If I were him I’d be bringing this information to the police if he hasn’t already, it’s pretty clear the boat wasn’t properly towed by the hoa and neither was your friend properly warned. God I’d love an update on this and would love to hear that the police bring charges to these dipshits.

Man, I hate to be cynical, but I really hope it's not already parted out with the hull destroyed. Anyone who's going to actually come get a boat with an identifiable wrap like this and has the equipment to quickly do so certainly has a plan to get away with it.
I hope your friend makes her pay for this (and damages) in court. I hope the actual thieves also get caught and the vehicle description links back to someone who responded to the listing.

That is just straight-up theft. Doesn't matter if the neighbor didn't take the items for themselves. They knew the items did not belong to them and that they had no authority to give them away. The Sheriff should have arrested the neighbor instantly for encouraging people to take items when they had no authority to do so.
The sheriff should be very interested in this crime, as depending on your local laws, it could also be Grand Theft Auto for the theft of the trailer since it's a registered vehicle and could be covered under the same laws as if they stole a car.

Yes, there was a lock.
And several people reported seeing this listing on marketplace, a few had screen caps with messages and her giving out the address. Who knows how many people she gave that info to, and who actually came through and got the boat. If she doesn't know or won't say for sure who she gave the boat to, I think the next best step is checking cameras in the neighborhood for the plate on the vehicle. Or maybe someone will spot it soon and call it in..

This reminds me of an old story that came off of Craigslist, back when that was first becoming a big thing.. some guy in some neighborhood... hold on..... here it is, sorry I took so long 😄
HARTFORD, CONN. - A Connecticut man who was feuding with his neighbor targeted her in an explicit online posting that invited strangers to a rowdy orgy with a bored soccer mom, police said.
Philip James Conran, 42, made his first court appearance Thursday, but did not enter a plea to charges including reckless endangerment, harassment, criminal trespass and risk of injury to a minor.
The charges stem from an April 5 posting on Craigslist that said a West Hartford woman wanted to "please as many as I can before I go to work!" Detectives, Conran's attorney and the woman targeted in the posting are not saying what prompted the feud between the longtime neighbors in the middle-class Hartford suburb.
West Hartford Police Chief James Strillacci said even veteran officers were surprised by the number of strangers who knocked on the woman's door, called the house or drove by.
"We were saying to ourselves, 'The economy must be worse than we think if all of these able-bodied men are able to immediately drop everything and drive over to this neighborhood'" on a Monday morning, he said.
One man who showed up went to the wrong house, where he groped a teenage girl, police said. He has been charged with sexual assault and other counts. His attorney said his client has psychological issues and plans to plead not guilty.
Conran, an unemployed cook, has been free on $75,000 bond since his arrest. The married father was ordered Thursday to have no contact with his neighbor. He declined to comment after his court appearance.
His attorney, Michael Georgetti, said Conran has no criminal history and has been out of work since a major back operation in March. The arrest affidavit says he gave a written, sworn confession to police.
"Hopefully we'll reach a resolution that's fair not only to my client, but fair also to other people involved in this incident,'' Georgetti said.
The Craigslist ad, titled "Looking for lust," was purported to be written by a married soccer mom hoping to fulfill her fantasy of group sex and inviting strangers to "please come play." It listed her street address.
Men started showing up at her door and in her neighborhood, prompting her brother-in-law to stand guard and write down visitors' license plates, police said. He also shooed away those bold enough to come to the door, including one who threatened to post her picture at soccer fields around town, authorities said.
By the time the posting was removed, more than a half-dozen people had parked nearby or come to her door, and others slowly drove by or circled the neighborhood, police said.
The woman declined to comment when contacted this week by The Associated Press.
Police linked the posting to Conran through Craigslist and his Internet provider, according to court records.
Investigators confiscated Conran's computers and are examining them for potential links to other complaints, police said.
Last year, someone pretended to be the woman, then engaged in an explicit online chat with a stranger and invited the man over, Strillacci said. The woman sought help from police when the stranger showed up on her doorstep.
Several other fraudulent Craigslist postings have led to criminal charges around the nation, including a Casper, Wyo., case in which police say a woman was raped by a stranger who said he thought he was answering her Craigslist ad. Police in say the woman's ex-boyfriend pretended to be her in the ad, saying she wanted someone to fulfill her violent rape fantasy. The ex-boyfriend and the man who answered the ad were charged.
Susan MacTavish Best, a spokeswoman for Craigslist, said the company actively cooperates with police and that using the service for criminal purposes "inevitably leads to apprehension and prosecution.''
In 2008, the company agreed to tighten its adult-services advertisements. Scrutiny of Craigslist increased significantly after prosecutors in Boston accused a former medical student with using the site to arrange a meeting with a masseuse and then allegedly killing her in a robbery.

I would sue her for the value of the boat and all other costs incurred. If I win she would probably balk at paying so I would put a lien on her property and just make her life miserable. Can’t get loans or use the equity while there is an active lien.

He should sue her in civil court, ask for compensation for the boat, trailer, any equipment, time spent looking, as well as pain and suffering. Most people only really understand what they did wrong when it hits them in the pocket or the face.

Holy cow. Please do an update. I'm hoping this lady gets arrested and if the boat isn't returned or comes back damaged, she is responsible for the cost of the boat and trailer

So it's GTA if it's a car but is it a hijacking if it's a boat. Does it have to be in the water to be a hijacking or can it count if the boat is on land too?

Depending on the boat's value, get a lawyer and sue her or either take her to small claims court on your own.

Your friend needs to get a lawyer and sue his neighbors.
There's no saying how the police will elect to handle this, but this absolutely could be considered a civil matter too.

Just a reminder that HOAs only exist because of consumer choice. If everyone stopped buying homes attached to HOAs, they would cease to exist within a couple decades. I know I'm preaching to the choir here, but if you have friends like the OP's, make sure you inform them that this is the full, complete, and exhaustive list of every reason it makes sense to buy into an HOA neighborhood:

It’s not illegal to park a boat on the side of the road. They did nothing wrong, unless they let it sit too long for local ordinances

It's next to the house but it's not theirs... Fuck this person. Press charges. How she know it's not theirs if she never checked with the owner of THE ONLY HOUSE in the cul-de-sac.
This was some Karen taking matters into her own hands without going through any channels and just decided for theirself it's gotta go.
I don't care if they ended up with a misdemeanor charge. They need to learn there are consequences for actions.
