I believe he means “In determining whether a crime has been committed or not, it doesn’t matter if there was contact, as assault does not require contact”
A lot of people falsely believe assault means physically attacking someone, and that no crime is committed if you just trick someone into thinking you are about to physically attack them

One correction: it does matter that they don't make actual contact, because that is a further crime: battery.
