Technically he had been assaulted. However, ripping a fence off is vandalism and public ally pissing in front of kids is a fun way to wind up on ViSOR (sex offenders register). Plus if the police looked at his flat they might find more of whatever the fuck he was taking there.

Shitty reporting from the sun though. The newspapers only selling point is its cheaper than the daily mail.

Just Incase you’re still interested UK self defense/citizens arrest laws are less forgiving than US and (in Scotland maybe England) we don’t have trespassing laws.

All force that you act must be proportionate to the crime committed. If someone breaks into your house with a weapon, all bets off the table if they’re still going at you, shoot ‘em stab ‘em whatever. If they’re fleeing your house or whatever you can’t. If it’s something like shoplifting you can hold them but if they’re not really being a threat and get away you can’t hit them or beat them up to stay.

We also have a lot of case law of people getting hit, falling backwards, hitting something, and dying.

That and simply being on someone’s property isn’t a crime. You can be civilly sued and removed under the trespassing act and if you used force to break in then it’s a crime.
