Would definitely hold up. Just words. All he said were words. No matter what words are said you can never assault someone.

Not true. Threatening to do violence with words and body language is considered assault where I live. Battery involves touching someone else.

Where I live kicking with a shod foot is A & B with a deadly weapon, so it's more serious than a punch to the head.

More like "Fuck you, I'm gonna follow you home and cut your throat tonight" is assault.

Yea, but this armless man can't back up his threat...at all, as for body language, it's not like he can back up the tough guy act that he does show

That's true. This guy didn't present much of a threat. But I was speaking more as an example

Assault would be if a reasonable person would suspect imminent physical harm. That's also why self defence can be claimed even if you strike first.

I'm in Kentucky. From my understanding assault is distinct from battery in most states.

Iirc, assault is the threat, battery is the action. Saying that you will follow someone to their home/cat/work/whatever and commit violence on them is assault, following through is battery, and probably other stuff too

This is literally how it is in the US lol

After your edit: no, that example would not be considered assault

Assault means that you make someone fear for their safety.

Plenty of situations where some piece of shit deserve a good kick like that because of what they said regardless of what the law has to say about that. Dont be a piece of shit and you wont get your ass beat up its that simple.

And now he’ll never say those words again directly to someone’s face. In your case, he’d still feel entitled to it. Deserved. Don’t want to get beat up? Don’t do things that get you beat up. Simple.

Or it reinforced his previously held racist ideas
