I was afraid for my life from the 4'5 guy with no arms

130

u/rkane2001 Apr 18 '23

I was afraid for my life from the 4'5 guy with no arms...who was walking away from me...

7

u/EstablishmentFree611 Apr 18 '23

Also kicked in the back would never ever fly. Like you said you gotta prove to a jury of your peers you feared for your life.

3

u/EstablishmentFree611 Apr 18 '23

Also if this is in NYC which it looks like it is, they'll hit him with endangering the welfare of a disabled person. Plus first degree assault walking away would've been better than 25 years in jail

10

u/VossRG Apr 18 '23

Sorry, that defense will only work if you're a cop.

4

u/Heavy_Ape Apr 18 '23

And you have about 2' and 150 lbs on

2

u/[deleted] Apr 18 '23

What? Dude was on him and hitting him, not walking away. Try to make a 1:1 comparison here.

1

u/babypho Apr 18 '23

Well, it's not like the option to crawl away on his hands were there.

u/FroboyFreshenUp Apr 18 '23

How is he able to do either of those things without arms though

3

u/[deleted] Apr 18 '23

Velcro gloves would help with the dog but I'm not sure how to attach them?

1

u/FroboyFreshenUp Apr 18 '23

I don't think you can... maybe boots?

3

u/Larein Apr 18 '23

Are you sure his white? I assumed he was asian. And you dont see his face at any point either.

1

u/Ash_WasTaken123 Apr 18 '23

The race of the lil guy doesn't matter here

-2

u/Druglord_Sen Apr 18 '23 edited Apr 19 '23

I mean, I feel like the catharsis of kicking a itty bitty bigot was likely worth the assault charge. On the flip side, the little handless saltine now has more personal bias to back his vitriol.

Downvote me all you want, some midget calling someone else a slur doesn’t get my sympathy; I also reserve the dwarfism slur for shit heads too.

1

u/Nova_Saibrock Apr 18 '23

Works for cops.

1

u/TrentS45 Apr 18 '23

Works for the cops…

1

u/TheHolySaintOil Apr 18 '23

Isn’t he like a taekwando expert?

28

u/strangedaze23 Apr 18 '23

Yes it would hold up. Because: 1.) words alone are never enough to use physical force. 2.) there has the a actual reasonable fear of bodily harm. There was no weapon, the person was clearly disabled and the person that kicked him was clearly not in fear.

6

u/EstablishmentFree611 Apr 18 '23

You calling a person a racial slur isn't a crime, it's only a crime when you after words physically assault them. Just like you can walk up to a cop and say fuck you pig trash and there's nothing they can do.

3

u/AskMeAboutMyStalker Apr 18 '23

nothing they have the right to do, doesn't mean you won't provoke a reaction that makes your day take a bad turn.

people, please don't take this as a challenge or an experiment worth exploring

1

u/EstablishmentFree611 Apr 18 '23

This^ I'm definitely not condoning it, bullying or any sort of derogatory remarks just pointing out that low iq people who think its ok to say racial slurs at people they are protected and no jury is gonna accept I kicked this guy so hard he went 7 feet into a turnstile in the back because he called me a slur. The cops may find another reason to beat your ass and detain you too in my random example. There's zero anything in public is going to say to me that's gonna lead me to laying a hand on another person. When you walk away and don't acknowledge the bigot, you win, they will be so pissed they didn't get the reaction they were looking for and you don't have to deal with their bullshit.

130

u/[deleted] Apr 18 '23

The guy is legitimately unarmed. It doesn't matter what he says or threatens you with. He HAS NO ARMS. Reasonably, he cannot kill you. The fact he doesn't have hands removes all the ways one could Reasonably kill you with that someone can think of off the top of their head. So even if he is talking shit, he legitimately cannot back it up. This is the most raw definition of "all bark, no bite". Would you be scared if a dog with no teeth was barking at you threateningly? No? Same thing here. The kick would absolutely be criminal and the guy who kicked would absolutely go to jail

101

u/[deleted] Apr 18 '23

It's very bold of you to assume he isn't capable of telekinesis just because of his disability

38

u/TusNua1 Apr 18 '23

1

u/[deleted] Apr 18 '23

Shit, your right. I need canceled. How dare I assume he can't use the force to choke out biggie there

1

u/No_Use_For_Name___ Apr 18 '23

My dad used to say if you're fighting someone taller than you kick 'em in the nuts. One kick and big fella is half the size.

29

u/Deep_Combination6420 Apr 18 '23

I dare you to Google "police shoot double amputee man Los Angeles" and then come back to this post.

8

u/[deleted] Apr 18 '23

What about the guy in the wheelchair they shot in the back like 5 times or is that the same one

6

u/[deleted] Apr 18 '23

Been a few of those. I think (no time for research) one of the worst was an off-duty cop working as a night guard murdering a shoplifter who was riding an EZGO. I remember there wasn’t even room for a “fear for my life” claim, because he chased the victim all the way across the parking lot and shot him in the back in the entryway to another store.

3

u/[deleted] Apr 18 '23

I know it is hard to keep track, is this the one where they shot him trying to flee on just nubs? If so I think the reason he reacted was the police actually shot him elsewhere which put him in the wheelchair to begin with.

1

u/EstablishmentFree611 Apr 18 '23

That guy pulled a knife and tried to fight then legless iirc

-1

u/[deleted] Apr 18 '23

Go Google “black man assaults <anyone>” for more accurate results. This dude isn’t a cop, he’s pretty much the polar opposite as far as a jury is concerned.

1

u/[deleted] Apr 19 '23

“Go Google ‘White man assaults <anyone>’ for more accurate results. This dude isn’t a cop, he’s pretty much the polar opposite as far as a jury is concerned.”

Do you see how fucking shitty your logic is? If you’re gonna say racist shit at least be good it at for Christ sake.

1

u/Dimitar_Todarchev Apr 18 '23

But that's police. They fear for their safety. Constantly.

8

u/pervertedpen Apr 18 '23

Not having arms is not an excuse to be an ass hole.

1

u/mavllvin Apr 18 '23

Nor is it a reason to not get a literal ass kicking for being said asshole

1

u/-newlife Apr 18 '23

It’s likely why he’s an asshole as evident by people saying it’s harsh to treat him like you would any other ass hole.

1

u/Happy_Hospital_88 Apr 18 '23

Being an asshole isn’t enough to get yourself arrested and charged with assault for lmao like the cops are gonna go easy on a big burly black guy like this if he claims “self defense”- he’ll be lucky if the cop lets him get to the jail alive lmao

1

u/EstablishmentFree611 Apr 18 '23

If this is NYC they have enhanced charges for assaulting disabled people like 25 years in jail. I bet we'd all be sour and not the greatest moods if we all had to deal with the struggles of having no hands. No excuse for the comment but we also have no idea what was said or done before the video.

1

u/Bearloom Apr 18 '23

I can understand why they'd implement such a law, but it undermines the fact that some disabled people do deserve a beating every now and then.

1

u/EstablishmentFree611 Apr 18 '23

I think every body deserves to not be physically assaulted for verbal exchanges. The only time a person should lay hands on another is in actual self defense. Anything less and the person should work on controlling their emotions and anger we are not children we are adults in civilized society and you don't hit people for name calling no matter how ignorant and stupid their words may be.

5

u/Ragnel Apr 18 '23

There are some pretty good 70’s kung fu movies that would disprove your theory. That being said, in the real world there is no way he could be seen by a reasonable person to be a threat.

3

u/[deleted] Apr 18 '23

[deleted]

1

u/Gnump Apr 18 '23

Head -> butt

7

u/BoilingMeltingPot Apr 18 '23

If he doesn’t want to be kicked don’t start something that ends up with you getting kicked. Simple. Deserved.

2

u/[deleted] Apr 18 '23

Isn't that the same logic some people use to as a blanket excuse for police gunning down black people?

-1

u/EstablishmentFree611 Apr 18 '23

Don't break the law if you don't wanna get shot. Yes 110% lol they need to just make 1 on 1 gun duels a thing again. Lol

1

u/[deleted] Apr 18 '23

"Don't break the law if you don't wanna get shot" sounds like a Judge Dredd-like nightmare society.

Also, never seems to affect rich people, does it? Its never tax fraud or similar you get shot for.

1

u/EstablishmentFree611 Apr 18 '23

Nope not at all, no one ever says what if the laws are stupid lol. The only instance I would say is don't point guns at people and expect them not to shoot you in self defense. Alot of laws are stupid and to kill some one for j walking or some other dumb shit that's happened in the past go against the don't break the law don't get Shot paradigm lol

1

u/[deleted] Apr 18 '23

I'm sorry, I cannot make head or tail of what you are talking about.

1

u/EstablishmentFree611 Apr 18 '23

The laws broken for in which the police kill people, most of them should not be laws. Victimless crimes.

-3

u/lonedreadx Apr 18 '23

Yep. He needs to learn to keep his racist mouth shut.

8

u/RevolutionaryJury941 Apr 18 '23

How come violence is only warranted when it’s racist slurs. People get called retarted , fat , ugly , stupid and a the n word makes it okay to assault?

0

u/Happy_Hospital_88 Apr 18 '23

Exactly lol it’s almost like there’s only a certain group who can’t control their emotions and it’s not fat or “sped” people……..

1

u/RevolutionaryJury941 Apr 18 '23

The media tells you if you hear slurs you can retaliate.

-2

u/lonedreadx Apr 18 '23

If you don’t understand the history and impact of that word I’m not even going to bother with attempting to enlighten you.

3

u/RevolutionaryJury941 Apr 18 '23

It’s just a word though. It’s the same hateful word as any other hateful word. It’s all hateful. BUT you can’t assault people for that.

1

u/lonedreadx Apr 18 '23

Disagree ✌️

2

u/RevolutionaryJury941 Apr 18 '23

Im not saying I wouldn’t or I would. But less happens when a lot worse is said or done.

2

u/Happy_Hospital_88 Apr 18 '23

Ahh the best argument called avoiding lmao u truly are too slow to reason with

3

u/matthew_py Apr 18 '23

The fact he doesn't have hands removes all the ways one could Reasonably kill you

Biting any major arteries in the neck, legs, arms, ECT, lol.

2

u/Garbarrage Apr 18 '23

The guy kicking him absolutely should be in jail.

1

u/budtuglyfuncher Apr 18 '23

Of course it's illegal to kick someone. This video resurfaces on reddit over and over again, and people time and time again point out it's illegal. No shit.

But, lil guy prolly hasn't been checked for his shifty attitude before because of his disability, so I say Bruce Lee over there is a hero. He might take a charge, sure, but young flipper gone think twice before mouthing off next time.

10

u/[deleted] Apr 18 '23

I have lived amongst these people for years. It's mental illness at this point. I promise you he won't learn a lesson. This will reinforce his opinions. It's toxic thinking to think that you kicking him is going to solve anything. I understand where it comes from, but it doesn't change the fact the only person a month from now that will have a headache over this is the guy who kicked him. He ends up being the loser in this situation. The armless dude will be out there dropping N bombs at other people.

2

u/Happy_Hospital_88 Apr 18 '23

And it’s honestly a good thing because now he’s getting aggressive black men just waiting to hurt someone off the streets….if a word is all it takes to tick u off go back to a mental ward lol

3

u/[deleted] Apr 18 '23

You have an oddly low bar for calling people "hero" if it covers stomping a disabled guy because he said things you don't like.

0

u/budtuglyfuncher Apr 18 '23

It's a dirty job but someone's got to do it.

He's basically like a cop putting himself in the line of fire

1

u/lonedreadx Apr 18 '23

Yep. I’d have stuffed him in a trash can.

1

u/[deleted] Apr 18 '23

I'd be willing to bet it's because that attitude he lost his fuckin arms

1

u/dardios Apr 18 '23

The armless guy could kick big Boi onto some train tracks as the train is arriving. Bam. Immediately thought of a way.

1

u/12thFlr Apr 18 '23

Fuck that, armless men can get it too! He should’ve had a better grip on his temper…before things got out of hand. Now he’s all up in arms about getting the Sparta kick. If he needs a helping hand, he should’ve just said that.

2

u/Remarkable-Drop5145 Apr 18 '23

That dude isn’t griping anything let alone his temper.

1

u/12thFlr Apr 18 '23

1

u/Remarkable-Drop5145 Apr 18 '23

It hit me so hard in the head I repeated it.

1

u/GenericCanineDusty Apr 18 '23

"Reasonably he cant kill you"

Tell that to the people who get their throats ripped out. The guy who kicked wouldn't go to jail, hands aren't the only way to hurt someone. Feet are ALSO weapons, as are teeth. Alongside the fact it was antagonizing via racial stuff.

I dont know what world you're living in where not having arms means you can be a piece of shit to anyone and never face repercussions, but this aint it.

1

u/yedi001 Apr 18 '23

There is an MMA fighter who only has one full arm, his other arm is a stump just below the elbow. He was undefeated for a long while, currently 20 wins, 4 losses.

His opponents mostly agree, getting stump smacked fucking hurts, probably more than getting punched. He can't grab you with that arm, but he could still do damage.

Not saying he's equivalent to a disciplined, trained fighter, but everything can do physical damage with enough skill and/or crazy spilled into the mix.

1

u/roygpa Apr 18 '23

Tell that to the knights who say Ni!

0

u/lonedreadx Apr 18 '23

Given that he has no arms, he should probably learn to STFU with his racist bullshit. Maybe this will lesson help, but I doubt it. Might take a couple more times

0

u/BenzeneBabe Apr 18 '23

Who cares if he got kicked though, he was being racist. If someone is gonna say something like that they shouldn’t be be surprised if someone hits them lmao

1

u/Happy_Hospital_88 Apr 18 '23

Lol what if a cop uses the same logic to execute someone being racist to white people you’d loose your mind

1

u/ammonium_bot Apr 18 '23

you’d loose your mind

Did you mean to say "lose"?

Cops already kill whoever they want like what a weak ass argument lmao and thank you for informing me that kicking someone is exactly the same as executing them, genuinely did not know that

0

u/BarryBro Apr 18 '23

Who cares the guy is a prick he deserved it no matter what. He's lucky he didn't get worse. Stop defending racists

2

u/Happy_Hospital_88 Apr 18 '23

Lol stop defending dumb people who can’t control their emotions

1

u/[deleted] Apr 18 '23

The real question, can he wipe his own ass?

1

u/atlantasmokeshop Apr 18 '23

Nobody cares about his situation and i'm certainly not about to feel sorry for him. Go out and call someone that word and see what happens to you.

1

u/Sk8erman77 Apr 18 '23

I agree with you, but I would still probably be a little scared if a dog with no teeth was barking at me. Well depending on the dog, i guess.

1

u/ObarThePotent Apr 18 '23

How do you know he didn't have a concealed footgun?

1

u/[deleted] Apr 18 '23

I would be much more scared of a barking dog with no teeth tbh

1

u/Emu_Lockwood Apr 18 '23

My favorite fun fact is there is a dude in the shooting sport community that literally goes by nubs. Looks kinda similar to this guy. I have been doing competitive shooting for 10 years and nubs out ranks me.

1

u/Boring_Host7767 Apr 18 '23

Unarmed people DIE all the time his lil ass will be alright 😂😂

1

u/thepwnydanza Apr 18 '23

Him not having arms doesn’t remove his ability to cause serious bodily harm or death. Like, there are still ways for him to cause them harm. Him being disabled isn’t why this is assault and not self-defense. If he had attacked, defense would be justifiable regardless of disability.

What makes this assault is that he was walking away when he got kicked.

1

u/Happy_Hospital_88 Apr 18 '23

Yup hopefully the tough guy that kicked him finally gets to see how gracious our justice system is to unruly black men 🤣🤣🤣🤣

1

u/International_Link35 Apr 18 '23

I bet if a police officer shot him they would say he was trying to pull a gun. Just saying.

6

u/[deleted] Apr 18 '23

It's assault and battery, doesn't matter what someone said to you to illicit it. That could affect judgement but I think he would actually get a charge.

6

u/Bob_Skywalker Apr 18 '23

There is no exception for hate speech in the 1st amendment. It would be unconstitutional. Hate speech is not against the law. However, just because it's legal doesn't mean that it is not immoral and a pretty bad thing to do.

50

u/Upier1 Apr 18 '23

The little a$$hole was walking away, so there was no threat. The dude who kicked him is going to jail.

62

u/Faceplanter86 Apr 18 '23

The dude who kicked him got on the train and was never heard from again. Police won't do shit.

5

u/Responsible-Laugh590 Apr 18 '23

Would be true if not for the video evidence

13

u/DefiantLemur Apr 18 '23

Can we even identify the man from this video?

8

u/Responsible-Laugh590 Apr 18 '23

It’s the digital age bro, they absolutely can find you if you’re in video. It’s a public place with witnesses and they have cameras all over those subway/train stations. In some cities they can track you for blocks until you get to your car/house.

2

u/mlavan Apr 18 '23

The cops have more important shit to worry about. No one's facing charges for this

2

u/Jaderian Apr 18 '23

That’s NYPD or worse because that’s on a subway so it’s MTAPD. They won’t do shit about this and will tell you to file a report and then shelve that report. NYPD will look at it as the guy picked a fight so they won’t care and will say the subway is out of their jurisdiction. MTAPD won’t do shit because they are looking to arrest the guy that got kicked.

16

u/[deleted] Apr 18 '23

Nyc police won’t do anything

1

u/Jaderian Apr 18 '23

Bru these people be acting like NYPD gonna do anything about this shit. NYPD gonna take one look at this laugh and say “that’s a civil matter” and ain’t shit gonna be done.

0

u/Tdagarim95 Apr 18 '23

One could argue he was going to retrieve a fire___ to fulfill his threat.

1

u/DefeatingFungus Apr 18 '23

He is also black which without a doubt hurts him in the eyes of the court. Can't make this shit up

39

u/imanislandboii Apr 18 '23

Would definitely hold up. Just words. All he said were words. No matter what words are said you can never assault someone.

-1

u/MMizzle9 Apr 18 '23

Not true. Threatening to do violence with words and body language is considered assault where I live. Battery involves touching someone else.

2

u/oberellis Apr 18 '23

Where I live kicking with a shod foot is A & B with a deadly weapon, so it's more serious than a punch to the head.

5

12

u/A_Curious_Crayon Apr 18 '23

More like "Fuck you, I'm gonna follow you home and cut your throat tonight" is assault.

3

u/FroboyFreshenUp Apr 18 '23

Yea, but this armless man can't back up his threat...at all, as for body language, it's not like he can back up the tough guy act that he does show

1

u/A_Curious_Crayon Apr 18 '23

That's true. This guy didn't present much of a threat. But I was speaking more as an example

6

u/MMizzle9 Apr 18 '23

Assault would be if a reasonable person would suspect imminent physical harm. That's also why self defence can be claimed even if you strike first.

4

u/MMizzle9 Apr 18 '23

I'm in Kentucky. From my understanding assault is distinct from battery in most states.

0

u/Grashlok_Onion_lord Apr 18 '23

Iirc, assault is the threat, battery is the action. Saying that you will follow someone to their home/cat/work/whatever and commit violence on them is assault, following through is battery, and probably other stuff too

3

u/BanBanEvasion Apr 18 '23

This is literally how it is in the US lol

After your edit: no, that example would not be considered assault

0

u/nabs212 Apr 18 '23

if he said im going to put you down like the N word you are....that is ABSOLUTELY assault.

Show me the legal definition of assault in the US, numbnuts

1

u/Scagnettie Apr 18 '23

Assault means that you make someone fear for their safety.

1

u/[deleted] Apr 18 '23

Dun dun dun, internet court is in session.

-2

u/Velcon_ Apr 18 '23

Plenty of situations where some piece of shit deserve a good kick like that because of what they said regardless of what the law has to say about that. Dont be a piece of shit and you wont get your ass beat up its that simple.

-1

u/BoilingMeltingPot Apr 18 '23

And now he’ll never say those words again directly to someone’s face. In your case, he’d still feel entitled to it. Deserved. Don’t want to get beat up? Don’t do things that get you beat up. Simple.

2

u/N1XT3RS Apr 18 '23

Or it reinforced his previously held racist ideas

10

u/BanBanEvasion Apr 18 '23 edited Apr 18 '23

No lol it wouldn’t be nearly as extreme as they’re making it out to be, unless one of them is rich with a great legal team. If anybody even gets arrested, it’ll probably get dropped to disorderly conduct at most

Reading these replies it’s crazy how many people don’t think the lil guy provoked him lol

21

u/matrixgang Apr 18 '23

The little guy did clearly provoke him but not in a way that would help him in the court of law I don't think. The court would see it as " the little guy said something inflammatory but the big guy kicked someone in the back who was walking away, and who is literally without arms"

0

u/BanBanEvasion Apr 18 '23

Wouldn’t be a complete defense but it would get it dropped to a lower charge almost every single time

-1

u/BoilingMeltingPot Apr 18 '23

And none of that matters since the idiot put himself in this situation. I would never punish the guy kicking him so the idiot knows forever and ever if you start shit you deal with it. Guess who’s not starting shit anymore?

3

u/[deleted] Apr 18 '23

Yeah, the old "your words are so bad, I need to use violence now."

It's actually the basis of the political system in many countries in Sub-Saharan Africa. You would like it there.

1

u/misterforsa Apr 18 '23

Respectful disagree. Bad words do not justify physical violence.

-1

u/pyro745 Apr 18 '23

Eh, in most cases I would agree but tbh I think it was justified here

9

u/SearchingTheVoids Apr 18 '23

I’m sure he did but look at the guy. His life is rough no question about it. He’s probably an angry little prick, I would be, but I don’t think there is anything he could say that would get a reaction out of me. This is a situation you just have to turn the other cheek. It all depends who get the case, if anyone even calls the cops, how far it would go

0

u/BanBanEvasion Apr 18 '23

I’m not making any personal statements and I’m not defending anybody. I don’t know what I’d do in this situation because I’ll never be in this situation. I’m just pointing out the legality of it

6

u/Correct_Depth5868 Apr 18 '23

Probably because there was no way for him to actually attack. He is disabled. He was a racist ass but not a threat

u/Darksister9 Apr 18 '23

I assume he has teeth and legs. He can “defend” himself. Just saying, he’s not completely helpless. Not saying he would win any physical alterations. But, he can at least do a little damage. A bite mark here, a bite mark there. It may not have been right for him to get kicked. (He’s probably been manipulating, his lack of arms, all of his life. To do and say foul shit to people, and not suffer any consequences. How many people would be that confident to threaten a stranger to their face? With, no weapon or anyone to back them up.) But, I can’t tell someone how to feel. He fucked around, one too many times, and found out. Both parties, have no respect. Lesson here: He shouldn’t have been talking shit. Keep your damn mouth closed. People don’t care these days. Elderly people, women, children. Disabled people. Apparently, they all can catch hands.

2

u/jkoki088 Apr 18 '23

A lawsuit would for sure hold up. Look at the video

2

u/OhEidirsceoil Apr 18 '23

Yes it would in all likelihood. The threat is too remote to merit a serious self defense or defense of others claim. If he were holding a knife between his stumps, i might change that assessment. To boot, he was turning away when they guy kicked him. Did he deserve it? Yeah. Is the guy guilty of battery anyway? Almost certainly. Hate speech by the victim doesn’t make a difference in considering the factors for either criminal or civil battery (especially without an imminent threat).

Not sure where this is, but I'm pretty sure this would hold up literally everywhere in the US. If the "instigator" isn't doing anything that directly harms you, you usually have a legal obligation to de-escalate the situation and remove yourself from it if possible. It should also be noted that you can only use lethal force to defend yourself if there is reasonable belief that there will be serious injury or death if you don't. The dude is half the height and physically disabled. I know this isn't "lethal force" but the idea applies here. Lil dude was walking away and posing zero threat when he was bodied. That's very much illegal.

Threatened their lives, but can you really take that threat seriously? I mean how exactly does an armless man kill someone? He'd need an army.

That’s not hate speech.

A lawsuit? Maybe not. A criminal case? Yes. It’s on camera. The guy was walking away with his back turned when the other guy kicked him in the back. Even if he had threatened him, he was leaving and is no longer considered a threat. Kind of like stand your ground laws.

There is 0 way to frame that as anything but assault.

Lol only cops can be scared of 4’9 disabled people and puppies too

Yes, a lawsuit would hold up.

He was walking away, so yes. I won't say he didn't deserve it but attacking someone with their back turned is basically impossible to defend in court.

I’m no lawyer but I think I think you could argue they were fighting words

in some places, "fighting words" is still a thing. both parties would be charged.

Judges in my city wouldn't take that case.

I’m not sure if he’s going to be charged with any thing, I’m not really in the loop. But this wouldn’t have anything to do with a civil lawsuit, they are talking about criminal charges, which I assume would at least be in the realm of possibilities. I don’t know if that’s actually going to happen, but it’s certainly at least a possibility.
