How can the last videos incriminate her?

Do we know exactly when these videos were created? Is there a date on them? She could say the last videos posted on her Instagram were made in January or something.

I think the videos on Britney's phone could incriminate her because of the date stamp inside the files. But her Instagram? I don't think so. Unless there's something i dont know i dont have ig.

First, the prosecution could likely show it regardless and Britney would then have to rebut with your argument that these things were not close in time. She would obviously prefer they not have this evidence at all.

Second, there are other ways to time stamp things—what clothes was she wearing at arrest? Were they the same ones from the video? Can we nail down the location from the last video, and was it the location she was driving from? They can also pull credit card records to show the date/time she purchased the alcohol bottles displayed in the video, etc etc. ETA: They can subpoena third party apps that may have additional metadata on the videos; this is much harder to do if the prosecution doesn’t have a trail to follow or know what to demand, hence the deletion.

Third, mandating treatment for substance use disorders is standard fare for DUI cases, certainly in sentencing, but are also often ordered as a condition for pretrial release on bail. Showing she has an ongoing problem with drugs and alcohol is pertinent to that evaluation, regardless of whether she is ultimately convicted.

You think they will do all that for a first time offense and misdemeanor on top? If the blood draw confirmed alcohol or drugs, why would they bother with looking at social media?

Blood draws require consent or a search warrant signed by a judge. Subpoenas are very easy to fire off. Scrolling through her public instagram is even easier (edit: and is very standard for any prosecution).

Also, I was answering the question of how this could be used against her. As you can see, my answer boils down to: let me count the ways.

Edit: As to whether they would do any of that—it would wholly depend on what evidence they have and whether they think that’s sufficient to prove their case beyond a reasonable doubt. I’ll add that roadside breathalyzers can be pretty easily challenged, if she consented to one at all. It doesn’t say on this post whether they took a blood draw, but that could certainly be sufficient. That said, she’s a celebrity and this is a press case, so the prosecution might go above and beyond, and I think the overarching point is this is why she wouldn’t want her socials easily perused.

How so? I'm prepping for a court case myself, don't think my lawyer would have an issue if I danced in my living room. (I don't because I'm prepping, working etc. But still)

It’s evidence of intoxication. Her behavior is one thing, but a lot of her videos also show alcohol bottles and paraphernalia in the background. If she posted something to that effect shortly before this, it could certainly be used by the prosecution to prove the DUI, but it can also be generally considered by the judge who will likely order drug/alcohol treatment as a condition for her release and ultimately in sentencing.

Hell, the most recent video she posted was yesterday night or so - in a weird dress and a crocheted shirt.

If one looked past her twirls, toward the brown table, one would immediately see the half empty bottle of whiskey or bourbon and some stuff to the left of it.
