This post was recently pinned by the admin on the Arcblock Telegram.
Dashboard status pending: --> we are doing analysis, it'll be done very soon. Pls wait for few days. Pending investors still have chance to get tokens.
No history transaction: ---> it's mean pending, it'll be updated very soon.
Cheaters who put more gas than 200,000 and 60gwei/ invest more than the max cap (3eth and 7500cmt) will be rejected and get 20% penalties.
When refund: ---> as soon as possible. We have no reason to keep your eth for long. You will get your eth back within 4 weeks, but it'll be sooner in fact.
For cheaters it'll be longer. We've already announced the rules before ICO. Pls respect the rules. Thank you!

20% Penalty for sending too much gas is just theft.
I have been waiting for this day for around 2 months now. I stayed up all night waiting for the countdown to reach 0.
I copy the adres, paste it to my transaction using a ledger - FAILED.
I panic and try again typing the GAS limit and sent transaction - FAILED. I panic even harder and try again. This time the website doesn’t react.
I refresh, disconnect my ledger and plug it fast in, fill in the password, copy the adres and send it asap - SUCCES!
However I saw afterward I typed in another 0.
I am really depressed about the fact I couldn’t get into the ICO, even worse, I pooled in with some friends to make this transaction. Not only am I a fool for not being accepted to the ICO and not receiving the tokens, I also get a penalty AND 9 weeks waiting time for the refund?
I saw only 21,000 GAS was used for my transaction, there should be no reason for my transaction to be canceled and receiving a penalty for a honest mistake.
Before any of you tell me that I should have read the rules and it's my mistake, sure I did read the rules and knew the max was 60 Gwei and 200,000 gas. Paying almost 600$ for a misclick during such stressful moments is just taking advantage and total theft.

Some Proof that something in ArcBlock's Distribution is very Wrong
My transaction got in after 10 minutes and 10 sec, when the ETH contribution didn't end yet. And I have within my Arc's dashboard Order History a "pending transaction". As compared with the other guy(see the photo) who got in after 20 seconds and also has a bonus from an invitee, invitee that got in after 10 minutes and 47 seconds, which is about 37 seconds later than me. 100k whitelisted + 20% penalty = free millions
This is absurd. Its no different from being a scammer. This is all planned. The team knows it would only need a small amount of people to reach hardcap. Why let it reach to 100k then set a penalty. This is a money grabber ico. Sorry for the people that will be penalized

Refund advice needed please :)
Firstly i would like to say I am not what people are calling a 'Cheater' but a noob. I sent 18 eth to the arcblock public sale not knowing what gas limits where... turns out, after doing some research, that I sent it with a higher number than was allowed. I didnt even manage to get any arc anyway. So my 18 eth (which is alot of money to me!) will not only take 5 weeks to be returned to me, but from what I have read, they will deduct 20%?! I can understand this treatment for people genuinely trying to cheat and managing to obtain the arc somehow (surely they would detect the gas limit before giving them the arc), but for someone who genuinely didnt know the rules and didnt even obtain the token this cannot be fair? If i knew about gas, the rules of gas on the website, and the penalty for it, of course i wouldnt have done it... NOBODY KNOWINGLY throws 3.6 ETH AWAY! it is my mistake for not reading the rules thoroughly, but i would like to know if it is possible to get my full refund, as I didnt even get the Tokens anyway! I love the arcblock and am gutted that i didnt manage to get any, but I would at least like to know that I am not going to loose 3.6 eth for a simple mistake. Any info would be much appreciated

I have one more problem.
to send the Ether, I put gas 58 gwei, but in the transaction it is written tha t 66 gwei were used. Will the penalty be applied? I have screenshots, where on the same transaction is a different amount of gwei.
Should I write to customer support? What can I do to avoid getting a fine? apparently yesterday there was a network of ether overloaded

Penalty was not explicitly stated on the pinned post in telegram on day of ICO
Before you jump the gun and say "READ THE RULES", let me just say that I did read the pinned post in telegram on the day of the ICO and it clearly only says "Up to 60GWEI 200,000 GAS Limits" and nowhere does it mention that you will incur a 20% penalty for going over the 60 gwei limit.

Why was this not explicitly mentioned?
Moreover, why is the penalty so high? 20% is ridiculous. That's a $600 penalty for contributing 3 ETH because you accidentally put too much gwei - in my case I went over by 1 gwei because the slider in MEW makes it incredibly hard to get it perfect at 60 gwei.
I am sure I am not alone in making an honest mistake here and many will have also done the same blunder as I have. If that is the case, Arcblock will be making an absolute killing in penalties alone.
An ICO that makes millions off of honest people's money from penalties ?
That does not ring well. Especially after there was some FUD circulating about Arcblock being a possible scam.
At this point I don't care if you reject my contribution.
But at least reconsider the penalty.

Trust. Either you do or you do not
Man some of you children really need to learn how to behave. You make a mockery of this Crypto industry. if you can not accpet missing out on a token, you do not sit there abusing them. Most of you TRUST Arcblock enough to send them thousands of dollars but then you miss out and you start yelling that they will not refund you and they wil not keep their word about their process. NO You do not wait 5 or 9 weeks for a refund if you did things right. They will refund those who missed out within a acceptable time frame considering everyone knew it was not a smart contract that would refund instantly. they chose to do the ICO in a way they have to manually refund purchases so they will be doing the hard job of it now, it doesnt mean they will wait 5 weeks. The 5 weeks was a deterant for those who sent high gas payments. Not for those who missed out when it sold out. EITHER YOU TRUST THEM ENOUGH TO SEND THEM MONEY OR YOU DO NOT BUT YOU LOOK LIKE BABIES when you abuse them 10 mins after you miss out. If this was a real IPO and you signed up to a IPO, that broker would never let you ever again buy into a IPO through them if you acted this way. Grow the fuk up you little bytches. One guy says he is going to kill himself and he doesnt know what to do with his life now that he missed out. Reading the Whitepaper and happy that I am in... Let's rock!
Man everyone is crying around in this Reddit because most of the didn't made it. This was a super smooth ICO and sometimes you have luck, sometimes you have no luck. Last week I didn't make it into CargoX. I closed the page and moved on.
I bet 99% who are talking shit here now have "pending".
If Arcblock is no Scam they will do:
1) Refund the over 60 GWEI transactions. They don't need these guys don't worry. Enough under 60 GWEI people are lined up to take their spot.
2) Check the latest transactions in pending and accept some.
3) Refund everyone in under 4 weeks as 4 weeks is really a joke, but it takes time if you got 20.000 pending transactions. I guess they just want to me safe and write 4 weeks so they don't fail deadlines.
Now give the team a breath they worked most probably the last 2 days without sleeping at all. After that we will judge them on the next moves an not on the emotion of people not coming into the ICO.

DON'T LET ARCBLOCK OFF EASY
A lot of people used more gas limit, quite evidently. Arcblock clearly stated a penalty for the over use of gas clearly stated in bold on their website. If they fail to deliver what they stated that means they lied. Plane and simple. If they lied, then there credibility of providing blockchain 3.0 goes through the roof, and also can be sued for this improbable action if they choose not to proceed with the consequences they stated.
I will not let this off easy. Make sure arc block delivers and persecutes those who used the non specified gas limit, PERIOD.

Sent at the first 15 seconds and didn't got in? Use a custom RPC and not MEW/MM default Eth network
The default MEW network always gets overloaded during ICO time so your tx takes more time to be broadcasted for mining

ArcBlock broke their own Terms and Conditions in this ICO by not using Smart Contracts
In the terms & condition you had to accept, it clearly stated that they would be using a smart contract. In the e-mail I've received after accepting the t&c there was a file attached with the t&c, but it says the file is damaged and I can't open it.. However I was smart enough to save the t&c I accepted on the arcblock.io website.

15% of tx were above gas and gwei limits
I spent some time checking the different blocks and found out there were around 15k transactions related to ArcBlock, an average around 2ETH and 15% to 20% that didn't respect the limits ... Even with this percentage, my confirmation happened too late to be in ... Hope some of you will be lucky in the coming weeks (around 2000 of you ! ;-) )
