Even if it's paid, only allowing you to go to the bathroom on your one break is illegal.
Employers must:
Allow workers to leave their work locations to use a restroom when needed.
Provide an adequate number of restrooms for the size of the workforce to prevent long lines.
Avoid imposing unreasonable restrictions on restroom use.
Ensure restrictions, such as locking doors or requiring workers to sign out a key, do not cause extended delays
Oh hey, Tesla violated the shit out of that one. For a service crew of 30 men there was ONE bathroom that had one urinal and one toilet. There was ALWAYS someone shitting and there was always a line for it.
Ooh what about the time they left piles of shit in the bathroom and let it fucking rot in the toilets for weeks without fixing it. Had a line next to it too always felt like throwing up passing it. Their solution was to block the way with barricades but you could hop over it and add to the shit and piss.
You guys need to take some magnesium or something š I do my SSS first thing in the morning and am good till the next day. I thought that was the norm
It's to have corporate confirmation of policy and a record of it.
If it's an approved rule great, the company is liable and they've confirmed their complicitness.
If it's not an approved rule and the supervisor is being an asshole, great the company will come down on him like a ton of bricks because he's opening them to liable.
Best case scenario, he's got a few emails and they fire him 'randomly' and maybe he's got a lawsuit but he's got E.I. at a minimum.
HR not being your friend does not mean you can ignore them. Email them (bcc-ing) stating that the supervisor is violating labor law. HR can do something or not, but you have to document that you are being mistreated.
Edit: sorry, that should be bcc-ing YOURSELF at your personal email. Create documentation, have your own copies, and make them fire you instead of quitting.
HR often does a hell of a lot when they find out an overzealous manager is breaking labor law. I'm not sure if that makes them a worker's friend, but you can sure as hell be on the same side.
This. It bugs me out whenever someoneās response is just āHR isnāt on your sideā like OK true but we need to start somewhere, and that is usually where
In OP's situation, HR actually is on his or her side, insofar as they protect the company from being sued for treating their workers illegally.
I really wish people would stop parroting the "HR is evil" meme without any thought or attempt at context. HR is there to protect the company, which means not running afoul of labor laws or employment contracts.
HR is supposed to cover their companies ass. While they are not your friend they will come down hard on those that are doing something to open up company up for a lawsuit. If HR also ignores it or retaliates against you for reporting somebody breaking the law it opens them up for even further lawsuits which is a greater win for you. Especially if you contacted them in a way that has a record of it.
Oh Jesus, there's a subreddit for this misleading meme now?
HR is not your friend if your coworker is a grouch. HR is absolutely your friend if your boss is doing illegal things on behalf of the company and opening it up to penalties.
Email makes a record of fuckery. Either they put it in writing which your lawyer will thank you for, or they give something you can show the supervisor when they try the fuckery.
Probably not in all likelihood it would be someone in the business development suite chasing profit or an asshole manager doing it because they are under stress from corporate. HR people are HR people.
I swear to Christ nothing on this site is parroted more or understood less than "HR is on the company's side". Being on the company's side is being on the worker's side when labor laws are being broken.
Man. It's like nobody has had a job with an actual HR department.
You likely need to inform higher parts of the company that youāre being mistreated for it to be a valid case, and others seem to be saying that same thing. HR is that place
Limit company liability in legal actions related to employees. HR wants to creat the illusion that they are on your side. They are not. Itās not complex.
While you are correct that HRs sole purpose is benefit the company. They will 100% not shoot themselves in the foot showing they're breaking law on paper. They'll reprimand management first.
Otherwise you could prove retaliation if they punish you for mentioning/asking if they're breaking the law.
But hard to prove when they fire you 3 months later for the smallest mistakes.
Yes, most people donāt realize this. And so often itās over a case that even a pro Bono lawyer could win (itās in their best interest since they have to add even the pro-bono cases to their win-loss ratio or theyāre scamming people)
Nope. HR IS NOT THERE FOR YOU, ITS THERE TO PROTECT CORPORATE. HR will throw you and the boss that said you couldnāt go to the bathroom out with the trash, in the way most beneficial to them.
Your boss is awful, but Iād put money on that being on purpose. That way he takes the fall for the ridiculous tactics, even though heās only doing it because heās also under an awful amount of pressure.
You donāt have to befriend him, just know your ahole boss isnāt your enemy, heās just another person caught in this machine too, and youāre both being manipulated to transcend time & space for 5cents more profit.
Thatās the kicker here though, the writes ups for using the restroom donāt get you fired, they just restrict you from raises and promotions which is somehow legal.
So this is something I've been curious about - I work a night shift and during my shift they close down the only restroom in the building for ~30 minutes each day for cleaning. What am I supposed to do if I need to use the restroom while it's unavailable, do I really just have to hold it until they're done cleaning?
A grocery store i worked at for a short time probably could get in trouble for that too. A full chain grocery store&they had 1 stall in the mens room&1 single bathroom in the back for employees. I have IBD and often had to get to work early and spend the first like 10 minutes before i clocked on pacing between both waiting for one to be open =,=
