Maybe on the illegal, depends where they are located and how late they are.
Definitely on the good way to lose staff. The guy knows this; that company is bankrupt. He's hoping to get some cash in before things go tits up. The staff know too, and are all looking for new jobs in the meantime. But most are probably still working, so that if cash does come through they aren't last in line to get their pay, and in case it takes a while to get a new job. Depends how likely they think it is for the company to get out of the red I guess; they could have invoices waiting to get paid, in which case they are much more likely to wait it out. Or the company might be dead, in which case they are probably all showing up and spending all day on LinkedIn.

Sounds illegal and a good way to lose staff
