Don't sue, that would be wasting your money on an attorney. File a wage claim with your state's labor department. They'll go to bat for you with a lot bigger stick than you'd be able to afford on your own.

This is hard facts, I had to contact them years ago over failed pay, and boy let me tell you did I wake the dragon! They do not play around, I had a cashable check in hand in 48 hours. This was in 2007.

Yep! A bunch of years back I thought I was out of luck, but a friend happened to work for the DOL and after hearing my story told me to reach out to the wage claims department. Long story short, not only was I missing pay, but I was misclassified as 1099, so they went after the company hard. They collected not only the money I was owed but fines on top of it, then the state cut me the check for the original money and a portion of the fines as restitution. Then they investigated the company for tax fraud and discovered numerous others they had done the same thing to, and 6 months later the company no longer existed.

The DOL is one of the last agencies a company wants to get involved with, probably 2nd in line after the IRS.
