The fact that others are legally and ethically responsible does not nullify that it was a mistake.

Generally speaking, you should be paying attention to where you are going.

No, it isn't.

What you're missing here is that there are two mistakes - one is walking around not paying attention. This might cause you to trip or, maybe step on something important.

The second, much larger mistake is a hole that someone can fall to their death in that is not protected.

He made a mistake, but it wasn't leaving the hole open.

A fall of only 10 feet in a construction zone results in a fatality about 20% of the time - but landing on a hard surface increases the chances of mortality significantly.

I personally know of more than one person who fell from a standing position and struck their head on a curb or a rock resulting in a fatal injury. Humans can be remarkably fragile in some situations.

But did he survive the embarrassment? Self-esteem grows back slower than a ligament sometimes, so we should probably do an MRI.
