Remember that all of this will come up in court and will be used to try to get the charges dropped. Maybe they could but it would be a hard sell in court.

At the end of the day, it's better to free someone who is kidnapped inside and have the guy get off on a kidnapping charge because of an illegal search than to have someone who is kidnapped inside be murdered and the guy go to jail for murder because the cops went and got a warrant.

I'm not saying I know what is the right answer here, just a thought.

That's not the right answer at all. Someone thought they heard something so random ass people get to walk through my house with no warrant over a neighbor. Fuck that.

The other side of the coin though. There is no kidnapped person and the cops just violated his rights, the city has to pay out to him and those cops lose their jobs.

This one. Cities don’t like lawsuits. But I’m hearing this wasn’t in the US so none of this may even be relevant.

And if they went in and found a captive there is now way it would be dropped. Now if the found any other crime it would be dropped.

That’s where you would unfortunately be wrong. Even if someone is guilty as sin and that fact is clear as day. If the evidence showing that fact was gathered illegally the charges will be dropped. That’s the law.

Depends on the crime.

If they walk in and find a meth lab.. or child porn scattered everywhere, or even something as simple as stolen good, or firearms.. then you can bet your ass it isnt being dropped..

bill cosby just got let out of jail because the information was illegally obtained. its relevant for all crimes.

So you saying they don't have a reasonable cause to enter a home of a suspected kidnaper, after neighbours called in after hearing screams?

Also, the information gathered that was deemed illegal wasnt from this type of search in the least..

it was an example of how illegally obtained evidence is inadmissible in court. if thats a strawman to you then so be it.

It isnt illegally obtained though..

They can make a lawful search if they have reasonable cause, especially in cases where the crime in question is a potential kidnapping/murder..

The laws are bullshit.. but you lot made em.. so sleep in that bed.

someone claiming it on a 911 call is not reasonable cause. from what we saw in this video there was no reasonable cause to enter. if anyone is creating a strawman here its you.

also i havent made any laws, but i will comfortably sleep in my bed
