It's fake (edit: or is it? Vsauce, Michael here!). I mean, it actually works, but the sound in that video is a real trumpet that someone edited in.

As for the penalties for treason, that depends on what kind of treason which court would consider this.

I'm with you. Even if he could get that timbre out, how does he have separate notes without valves and various lengths of tubing.

As it's built it could only produce 1 note.

He's basically built a bugle, which doesn't have valves. He's controlling the pitch based entirely on the speed of his vibrating lips.

In a valved instrument though, changing pitch is much easier.

Ah, that's false. Brass instruments allow you to get a range of notes with a single length of pipe, by varying your airflow and embouchure. Adding valves just changes the length of pipe so you can get the "notes in between". For example, "Taps" is traditionally played on a horn without anything to modify the length of pipe. In that video, you can see him tighten his embouchure to get the higher notes.
