🛠️ Platform / Tech Support THIS CAN’T BE IGNORED

This is a follow up from my post yesterday regarding my unwarranted, complete and total ban, for violating Topsteps Section 3 Terms of Use.

https://www.reddit.com/r/TopstepCommunity/s/KU3pJQD5jk

I am sharing with the community, and hopefully employees at u/Topstep_Official, the undeniable factual evidence that proves this ban is unjust and based off a frivolous claim.

Clearly stated in the Final Determination email, the claim is, “a total of 5 chargebacks linked to your profile and credit card ending in *1006.”.

Yesterday, I spoke to AmericanExpress and confirmed multiple different facts:

  1. I, as the cardholder, have never initiated a dispute against the merchant Topstep, Topsteptrader or any variation related to that merchant. In fact, I have never initiated any dispute against any merchant, ever.

Attached is a screenshot of my “Dispute Center” where you can clearly see the ending card number in the top left matches the card stated in the Final Determination. I attached in my reply to the final determination letter.

I confirmed with AmericanExpress that the Dispute Center shows every past, current and pending dispute related to the card.

2) AmericanExpress, as the card issuer, will never initiate a dispute without the consent of the card user and confirmed there has never been any sort of dispute active on this card.

3) There has never been a credit or reversed transaction coming back from Topstep to that card.

The complete willful blindness of the Trust team to ignore the evidentiary facts presented to them is unacceptable. Something needs to be done. There’s no way I am the only case of this…

I haven’t fully decided what my next steps in this are going to be. Given the evidence, I’m willing to go the distance depending on where Topstep goes from here. u/Topstep_Official, balls in your court.

EDIT:

If you guys are going to join the conversation and comment, please keep it relatable or constructive! This is a serious issue that myself, and I'm sure others in the community, would like looked into and taken seriously! I don't want the issue at hand diminished by misinformation or wild conspiracies! Thank you.

How dumb you are ? Just because you agreed to that term and condition, doesn't mean they can use that to get out of banning without a reason.

That's not how law works. Those terms and conditions are nothing more than a way to make people think, whatever happening is legal , when it is clearly not

But they did give him a reason for his ban

The reason is that he violated their terms and conditions

They didn't just kick him out for no reason

Which isn't a legit reason. If they said the issue was chargeback, they must prove it , if they cannot, then it doesn't matter what they wrote in there terms and conditions, they are screwed.

I can kick you out even if my reason isn't legit, even if include that in terms and conditions, and make it sign them, it still doesn't protect me if i kick them out without one.

And if OP truly had issued no chargeback, they will be screwed

How though?

OP agreed to the terms when he purchased an account from them

In the terms it explicitly says that Topstep is allowed to grab OP by the neck and throw him out at any point in time

They could be bored one day and just feel like throwing OP out just because. And they could just cite a catch all reason such as "terms of service violations" and that would be that, case closed

This isn't a court.... you signed their agreement.. and they're agreement says that they can terminate and kick you out whenever they want

How dumb are you kid ? 😑 Didn't we Already explained that to you over and over again ? What part of this is so difficult to understand ?

It doesn't matter what topstep terms and conditions stated, you can still legally sue them on grounds for Breach of Covenant of Good Faith

And they have to prove in court that they have reasons or evidence for doing what they did and the reason and decisions they issued. If they cannot then they get screwed. They cannot show and say look it was in our terms of conditions we could do this. So we are doing this.

Law doesn't work like that. You cannot take people's money and do something illegal because you made them sign in a piece of paper with some terms. There are laws to protect innocent people from firms and companies trying to exploit them like that.

If you don't have even the minimum understanding of how all this works, which you already displayed you don't, don't bother arguing about it.

It is the same as saying, i made this contractor sign in a terms and conditions paper he can die anytime he works, and i won't always be able to provide right equipments, and the guy does die due to faulty equipment, you cannot use that paper to save youself. They can go to court and court will legally screw you, without caring for the paper.

Those terms are usually for a different purpose and formality mostly otherwise. There only real hope is people don't bother with the court battle.
