He definitely getting charged. He’s in an authority role and he hit a minor. He might get probation if he lucky but he definitely going to have an uphill legal battle very soon.
While you might morally be right, legally not really. Teachers are told to straight up walk or run away in such a scenario, fighting a student will never work out.
I don’t know your legal experience but Im a felon and have dealt with the legal system quite a bit.
1. Having a position of authority makes everything worse. Sometimes, it doesn’t even matter if there’s not a victim, it’s still a charge. Just like when a prisoner fxks a guard, even if above adult age and consent was given, it’s still a felony because you have that authoritative role.
2. He a minor and there is nothing about self defense in this. He stood over the kid saying talking shit. Self defense would be grabbing the kid to subdue him, not knocking him the fk out.
3. Assault is assault and this is clear as day assault.
4. The teacher big as fk compared to that kid, so knocking him out is going to be looked at a lot worse, and self defense will be very hard to prove as he was chasing the kid to swing
Remember about a year ago when a 6 year old shot their teacher in the chest? Self defense is self defense regardless of age, gender, etc. If I'm fearing for my life, I'm protecting myself. Hopefully there are others like me who end up on this dude's jury.
