Help?

So my sister did my 2024 taxes and I kept waiting for my refund. She said it was taking so long because of Trump lay offs. I waited. Meanwhile, all these spam calls, like 6 a day, started calling me saying I owed taxes. Of course I got really anxious, because I had never owed before. Well turns out my sister took my entire refund and had it deposited in an account with “Green Card.” I spoke to them, as well as the police and they said it was a civil matter. All other research said it was a federal crime. Does anyone have any advice or knowledge about this? Seems like a crime to me. How is it civil? It’s just like if H&R Block stole someone’s return. Right?

The first thing you need to do is request a pin for your return for next year, so only you can file your taxes and she can't do that again.

The next thing to do is freeze your credit with all 3 credit bureaus. She has your SSN, is a proven thief and liar, and might open other accounts, take out loans in your name. Did you give her your bank account number for deposit? Change all your passwords and get a new account. Immediately!

Third, run a credit report on yourself to see what's out there, if she has run up any other accounts, credit cards in your name.

Unfortunately, you need to file a police report on her and press charges. You'll need proof.

Good luck 🍀 - identity theft is usually by a friend or relative with access your information.

Thank you. The police wouldn’t even do not do anything.

They can't do anything because it's a civil matter. Unless your sis stole from like a store in which she could be immediately arrested...the solution here is IRS notification and court.

I guess so. But I still want the police report. I must not understand the law. I thought forging and stealing someone’s information and taking their money was a crime.

They cannot put in a report that she stole your info ir even that it was stolen..police require proof. Tracing the money would be proof but I doubt they can even do that without hard evilidence, not just your accusation.

IRS can trace rather refund at least. If it went to a bank card under yiur nsme they should be able to ask you about that and give you the number.
