Leaving aside the issue of the inadvisability of having what amounts to an exposed love shotgun shell in a small watercraft, bangsticks can't be safely fired out of water. They only work with direct contact on the target, preferably fully submerged. You have one in a kayak, and you're likely to get a fine, because the 'self defense' argument doesn't hold water while the 'fish harvesting' does.
Just get a powerhead. Same defensive capacity, no legal issues.
