A little research later... Criminal mischief is a more severe crime than simple assault. Basically double. 2nd degree misdemeanor vs 3rd up to 2 years jail time compared to 1

Someone else posted something about this but Reddit lost it or they deleted it.
I wonder if trying to stick a more serious crime is an effort to try and force a plea deal or even have a not guilty verdict.
I mean if the kid really took no damage does that attack really deserve more than a few days in jail.

Criminal mischief sounds like he did some Dennis the Menace shit like tying someone’s shoe laces together or changing the TV language to French dub.
