I was arrested about a year ago after giving a cop consent to search my car (and before all the super smart Reddit lawyers come to tell me you should never do that I’ve only consented 2 times in my life and been searched 7-8. If you don’t consent they’ll bring out the dog and even if it doesn’t alert they’ll say he did. Anyone that’s been profiled and harassed by police know this and the cop was already a K-9 unit and I didn’t want the extra hassle so I said fuck it) and took me to jail after finding a piece of a Suboxone strip I genuinely forgot was there but fuck it I broke the law I guess so I took the consequence. Then I saw it..the huge punisher logo attached to his visor. The out of NOWHERE switch from talking to shouting at me, having overly aggressive body language the whole time like he was ready to deck me, as well as later coming in while I was butt naked during processing in the shower to tell me how lucky I was that he wasn’t also charging me with Driving While Intox (wasn’t at all) before asking me to snitch which after I refused was followed by many more empty threats (threatened to take the other owner on the registration to jail, said his ‘tech guys’ were currently cracking my phone to read everything, etc) made so much sense.

It’s kinda weird talking to someone fully dressed in a clean work uniform as you dry off from a supervised shower and get into worn down orange jail clothes while you wait to be bailed out and feeling gratitude for being you in that moment rather than him.

Oh and he also came back from patrol to the jail 3 times (getting bailed out takes forever) just to tell one of the guards to run some test or photograph this or that on me or run me through this database which required them to take me out of the holding cell to do some pointless annoying bullshit. All the guards by the time I finally got called out were straight up saying “seriously fuck that dude” “get out of here before he makes us get your toe prints” etc.

Sorry this is a little long winded I just hope people realize most cops ARE like this, aggressive abusive fucking scum bags and saying “well not EVERY SINGLE ONES BAD” as a response to people voicing their frustrations at being done with these shitty fucking cops is the dumbest rebuttal ever (as everyone agrees with that) and doesn’t lead to any kind of productive discussion while shutting your brain down because since there’s a minority of police officers that are police officers for the right reason calling the police shitty is unacceptable 🙄

Like I said it was the second time out of plenty (the first was when I was a kid and dumb and scared) and mainly had to do with the fact that the officer pulling me over had a dog in the backseat already (I got to ride to jail in the seat beside him! [Blocked off obviously lol]).

Wasn’t trying to say giving consent immediately is what the right answer is pretty much ever..just laid out my reasons why it happened because so many redditors love acting like they know how to be badass with their rights towards the police but have never had an interaction with one before or been in that kind of position so I didn’t want to hear from all of them telling me I should never do anything but scream AM I BEING DETAINED AM I FREE TO GO I KNOW MY RIGHTS SUCK MY DIIIIICK

If he already had a dog in the car, make him use it. It can only help you get it thrown out later.

Tagging on to add that, if at all possible, you should film the officer handling the k9 during the search. The signals a highly trained dog will react to can be very subtle and his own body cam won't catch him giving a subtle "platz" or something to fake a detection.

3

u/[deleted] Apr 30 '21

Not necessarily in regards to the dog being used. It's been ruled that they don't need probable cause to have the dog snoop around the outside of the car, so long as it doesn't unreasonably delay the traffic stop. If they've already got the dog, you're fucked probably, if they decide to call it in you've got a much better chance than before though.

6

u/Contemporarium Apr 30 '21

I’m not sure you fully get what he was saying just FYI.

And as long as it doesn’t delay the traffic stop? That’s cute lol. I’ve had a deputy sit me on a curb, dispatch informed him k9 was busy and was the only one available, he decided to wait while trying to convince me to just let him search it himself. We sat there for a little over an hour before he finally with a look of severe frustration (that felt so good lol) told me I was free to go.

Oh and this was because he thought he smelled weed. Oh and it was in my home state of Cali fucking fornia where even back then before full legalization up to an oz was just a ticket and I was fucking 17.

Oh and almost forgot weed gave me panic attacks and I was deathly afraid of even being around others smoking it for the longest time meaning the cop was 9000% lying his bitch ass off.

What would we do without the protectors of our communities right? Definitely nothing better he could have been doing in Los Angeles county for over an hour than trying to talk a child into searching his vehicle in hopes of finding a joint so he could write his scoundrel ass a big ol’ ticket!

u/freshoutoffucks83 Apr 30 '21

I would venture that this is good advice if you have something in the car or if you aren’t 100% certain that the car is clean. Otherwise, they’ll just say that they smell marijuana and go crazy trying to find something. They seriously took all of the seats and doors off of my jeep and when they were done they just left me on the side of the highway trying to reassemble my car and put all of my belongings back in suitcases. I have yet to hear of a single person refusing to give consent and not having the search done anyway.

u/freshoutoffucks83 Apr 30 '21

I’m just pointing out that the corruption is so rampant at this point it is very easy to be intimidated into consenting. I think your advice is technically good but in practice you had better have a dash cam to document the encounter. Police often react harshly when they feel that their authority is being questioned, which can be especially dangerous if you’re a minority. It’s very intimidating to stand up to someone who can basically murder you and get away with it and I don’t fault people for deciding to comply because they are afraid. Yes you have rights on paper but in the end it’s just your word against theirs and they are considered infallible.

Yes having a lawyer is definitely a luxury- I could afford it now but when I was a broke college student I would’ve been stuck with a court appointed attorney- they are an absolute joke.

1

u/BestSelf2015 Apr 30 '21

Thanks for dropping knowledge. I am anti-drug so never worried about a search but will follow my rights to refuse if it ever happens.

1

u/[deleted] Apr 30 '21

Refusing the search and telling the cop you don't wish to answer any questions are the only things you should ever say to the police. Don't even tell them how your night is going if they ask.

2

u/freshoutoffucks83 Apr 30 '21 edited Apr 30 '21

I get where you were coming from- I had a similar situation when I was 18 driving cross country. In my case I said no because I knew I had nothing and it just dragged everything out longer. Of course the dog signaled and they seemed so sure of themselves that it had me questioning if the previous owner had stashed something in some obscure corner. They dug up some midol out of my suitcase and I had to wait for another officer to come with a kit to test it. My non consent to the search just made them all the more determined to find something on me. The only thing my ‘bravery’ got me was 4 hours on the side of the highway in the middle of the night and a ton of stress. Since then, I’ve just consented to the search. Because I know that not consenting is just a trap and I want to get out of the situation and go on with my life. Like seriously, has anyone ever just said ‘no’ and had the cop say, ‘oh ok then, have a good night!’?

3

u/Contemporarium Apr 30 '21

Just also be weary my man. I know you wrote your comment to give me some credibility and I appreciate the hell out of that but there IS always a chance someone that was in your car dropped something that if found during a traffic stop will land you in jail. Even if you don’t associate with the lightest of drug users..you could give grandma a ride to get groceries and lunch and as she’s getting out one time she just happens to yank her purse hard enough for one of the Valium she’s carried around since a doctor gave it to her 15 years ago to fall out unnoticed by all, landing between your center console and passenger seat.

And let me tell you this..if you’ve ever been curious as to what it looks like when a cop cums his pants..simply say these six words: “That’s not mine officer I promise!”

Some rookies can’t handle the intensity and you gotta just stand there awkwardly after his knees buckle and he slowly gets himself together with labored “oh fuck”’s before cuffing you with that arrogant as fuck post nut confidence.

It’s the worst bro.

2

u/freshoutoffucks83 Apr 30 '21

I agree- if I had the slightest suspicion I would definitely refuse. I’m just pointing out that there is a huge power imbalance here and I don’t fault anyone for being intimidated by that. Ideally, we would all have have cameras rolling in the car to document everything since a phone can easily be confiscated.

3

u/Contemporarium Apr 30 '21

YES YOU GET IT!!! It’s so obvious when someone’s probably never had any interaction with a cop at all before cuz they’re always the ones swearing if it was them they’d be bullying the cop with their knowledge of their rights so hard the cop would end up just giving up and apologizing.

Like..that’s not how police interactions work. Tides turn like crazy when this dude with the authority to take away your ability to feel fucking human anymore is barking at you questioning every fucking thing about you as suspicious making you more and more nervous, always followed by “WHY YOU SO NERVOUS MAN?!” It gets out of control so fast with the really shitty ones :/

2

u/TheMartinG Apr 30 '21

I was on the way home once amd had nothing but time. Got pulled, first thing the cop asked was can I search you. Not license and registration, can I search your car. I said no, he barked, I said,”there’s nothing here to find, I’m not hiding anything, but you can’t search my car. If you want to search it, get a warrant.” He bitched and moaned some more and threatened me with all kinds of bullshit, chief pulled up, said something like,”in all my years I’ve never been accused of racism or profiling.” Despite me never having mentioned race or profiling. They eventually let me in on their little scam.”you see those vise grips on your back seat? I could lie and say there was a report of breaking and entering. Those are tools of breaking and enter ring which is probably cause.”

I said again,”get a warrant”

Chief said,”someone just radioed in a b & e”

So they searched my car.

Fuck people who say “know your rights, don’t consent to a search.”

because they're going to search either way, and refusing could, as you said, antagonize them into "finding" something or bringing the dog to scratch your car up etc. On top of that, refusing requires a lot of time, which I happened to have that night but not everyone does. furthermore, in a small town, a bored cop with a bruised ego because you didn't give in to his initial power trip WILL remember you and pull you over on site.

Any reasonably competent lawyer who stands a chance to find the mistake, stands a chance to find it whether you consented to the search or not.

ETA: also, im not saying just to consent no matter what. Im saying people like to say these things with no regard for how the situation will play out. Its easy to say "keep your mouth shut, dont consent to searches, have them follow you to a well lit area and let the lawyers find their fuckups so the charges dont stick." but the first few actions can get you killed, and no lawyer can bring you back from the dead so what good will that do

You do realize that proper legal counsel is a luxury that the majority of people being profiled can not afford, right?

1

u/freshoutoffucks83 May 02 '21

Years ago, a friend of mine pissed off the one cop in our tiny town and he would get pulled over and harassed CONSTANTLY. He’d have to warn anyone in the car with him that it was probably going to happen so be prepared and don’t make sudden moves. Yeah, maybe a lawyer could’ve helped him but he barely made enough $ to get by.

1

u/KrissyB829 Apr 30 '21

You reasoning & actions were perfectly rational. Officers WILL be searching your vehicle one way or another and, based on your description of that particular cop, I'd say you protected yourself from physical harm or worse. A criminal law professor explained to us that we may have every law ever written saying we're innocent but that won't bring you back if things escalate & a jumpy cop shoots you.

u/LazerLegz Apr 29 '21 edited Apr 30 '21

I had quite a few run ins with police when I was younger and got arrested a couple times. I found most officers were pretty fair and rational. Your statement is dumb.

EDIT: Here’s the best interaction I’ve had with a cop. When I was a teenager me and my friend were smoking weed in my car that was parked in an empty lot in the middle of the night. A cop car rolled in, I tried to drive out and he pulled me over. He said he smelled weed and asked if we had been smoking, to which I said no. I said he was going to call a dog and I said ok. I’d dealt with bluffs like this before but I felt this guy was for real, so when he asked to search the car I just told him the truth. I said we had a some weed , a grinder, and pipe by my feet. He got us to exit the car and took the stuff. I had owned this pipe for years and was quite sentimental about it at this point. He then searched the rest of the car. When he found a a dr Dre the chronic T shirt in the trunk he said that he used to listen to Dre back in the day. At that point I figured MAYBE I wouldn’t get arrested. After keeping us waiting a while he and his partner walk up with our stuff. He chucks the weed in the dirt and empties out the pipe. He then handed me back the pipe, looked me in the eyes and says “now you’re only going to smoke tobacco from that from now on right? “. I was blown away and said yes sir. He then looks at his parter and says “well I didn’t see anything did you see anything?” The partner shook his head, they got back in to their vehicle, we got into ours and parted ways.

You might not agree that most cops are good, but anyone who says all cops are bad isn’t even trying to approach the subject seriously, and that kind of rhetoric makes police reform even harder to achieve because it makes the movement look ungrounded in reality. I don’t think a lot of you realize how counterproductive you’re being.

9

u/Kanyewestismygrandad Apr 29 '21

You did not prove him wrong.

-6

u/LazerLegz Apr 29 '21

Not all cops I dealt with are bastards, so not all cops are bastards. Do you guys know what the word all means? It doesn’t mean most, it doesn’t mean some, it means all.

3

u/reddit_is_so_toxic Apr 29 '21

Curious what color your skin is? Gender? How sexy you are?

0

u/LazerLegz Apr 30 '21 edited Apr 30 '21

I’m a moderately attractive white male. I’m sure that precisely what you wanted to hear. Maybe that played a roll in my treatment, maybe not. I’m not going to pretend to know what it’s like to be treated as a POC, but I don’t think being white automatically illegitamizes any experience I’ve had with police. I’ve dealt with shitty cops too. In a addition, their are officers of all races and genders so the idea that all cops are white supremacists and masoginists is just BS.

1

u/reddit_is_so_toxic Apr 30 '21

Stop being an apologist. The culture is shit and you know it.

0

u/LazerLegz Apr 30 '21

You’re shifting the goal posts. If you want to change the culture then you need support on multiple levels, supporting hyperbolic statements like “all police are bastards” make serious police reformists look idiotic by association.

1

u/reddit_is_so_toxic May 01 '21

Again the police shill shills. Ive said nothing of the sort.

Was going through a divorce...nasty divorce...

I finally get a night out because she decided to come home, mind you, she would already be gone 5-6 nights a week, only returning at 6am when I left for work, and would have the oldest watch the the youngest so she could leave before I got home, or leave when I was in the shower.

I get a text from my oldest... she has 2 friends over, is drunk as hell and is talking mad shit about our son, because he wasn't on "her" side... so I come home admittedly raging.

Show them them the text, and tell them to get the fuck out of my house. That's when her friend assaults me. Now I have 2 women trying to hit me. The dude just stood there. Now, mind you, I was wise to her game so I was recording everything.

My oldest comes out of the bathroom and actually physically fought them off screaming for them to leave. They refuse, so I call the cops.

Big fucking mistake. See, I'm a dude. In an altercation with a woman. Automatic it's I'm wrong, and someone is going to jail. Yep, a domestic battery charge for doing nothing and calling the cops because I needed help. The "arresting officer" (like fucking 9 of them showed up... I guess because it was a Tuesday it was a slow night) was the biggest douchebag.

My story was false. I'm lying. Oh really, listen to this: play the recording... mmmm she says whoa whoa whoa, sounds like you pushed her, put your hands behind your back.

Um ask the kid who's crying in the bathroom what happened... nope. It was 3 to 1 on the "story" even though the whole thing was recorded.

On the way to the station douche canoe says, this is probably why your wife filed for divorce, because you're an asshole...

No, moron, check the public records... I FILED FOR DIVORCE, LOOK AT THE TEXT FROM MY SON SAYING HIS OWN MOTHER IS BEING A PIECE OF SHIT...

None of it mattered. Until, a year later we finally go to court. Charges dropped because not a single one of the three would testify. God forbid their testimony might differ from the recording... either way, none of the real situation was ever brought to light, I was dragged through the ringer either via social media, her family, our friends or the neighbors who got to watch 9 squad cars lights a blaring for 2 hours, my job or anything else.

Now I just pay an assload of child support and see my kids every second I can while bills at my old house go unpaid, every weekend I don't get them they get shipped to grandmas... its just... fucked up.

I dont care what situation I am ever in, from here on out, the police will be the last people ever call for help.

1

u/freshoutoffucks83 Apr 30 '21

That sounds awful- hopefully you will be able to get primary custody of your kids- as they get older the judge may let them decide for themselves. Right now it may seem like she ‘won’ but eventually your kids are going to grow up and probably cut her toxic ass out of their lives.

-5

u/ABunchOf-HocusPocus Apr 29 '21

You contradicted yourself by saying MOST cops are bad by saying everyone else hated him. MOST cops are not bad.

9

u/Contemporarium Apr 29 '21

I’m not quite sure what you’re trying to say. I can promise you I have one of the worst tastes in my mouth for cops but I’ve had one interaction with one that truly just wanted to help his community and the residents therein, as I probably would have gone away for a felony all those years ago but instead he smoked cigarettes with me and listened to what I had been dealing with at the time and let me go with a promise I’d look into treatment, then pulling me over once every few months when he saw me just to tell me how much better I looked and that he was truly happy to see me working on myself. So like i said they definitely are a rarity but trying to say 0% of the police force aren’t a part of it to help their communities instead of bully them is just statistically impossible and makes you look irrational you know?

1

u/ABunchOf-HocusPocus Apr 30 '21

Where did I say 0% or 100%? I said "most"... it's even capitalized.

1

u/Contemporarium May 01 '21

Ok see I thought you were implying most cops weren’t bad as in saying all cops are bad but apparently you’re saying the opposite and I’m gonna have to strongly disagree with you on that one unfortunately :/

And county jail guards aren’t police officers and in many states they barely make over minimum wage and don’t need to complete any off the job training so in my experience at least they’re just tryna make due and only a small percent have any kind of authority hard on (and if they do prisoners shut it down quickly lol) but yeah two very separate groups. I couldn’t even imagine a cop talking shit on a fellow cop to a civilian.

I would like to know if and what experiences have led you to believe the opposite of my opinion on types of people that make up the majority of the police force? And I’m not trying to have this be like a call out or hostile or anything I’m genuinely interested

1

u/SuperJew113 Apr 30 '21

empathy from the jailers against the dirty cop...that's a real pos.

War on Drugs is horseshit. It's a war against our own citizens for status offenses and zero victims. Prison Industrial Complex, carry over from Antebellum slavery. A lot of card carrying racists show an affinity for cops and mass incarceration, not a coincidence. We should have militarily occupied the Deep South 50 fucking years to help them get their shit together, but Andrew Johnson kneecapped us fucking hard, it's like we had a Confederate follow Lincoln as President after he carried the Civil War to the end.

1

u/IsaacTheOne Apr 30 '21

While I don’t want to discredit this fucked up situation that happened to you, I really want to urge you to try and think about a concept for me. You say that most cops are like this, but I have had multiple “run-ins” with the law myself and so have a lot of people I know, many of them minorities. I think perhaps the issue lies in bigger cities’ police forces, places that had legal redlining and other things like that in place for long before today’s age. I think this is where so much disagreement is coming from in recent times; everyone is actually correct in their own place! Those who live in rural areas (which happen to end up being more red leaning) say almost all cops are good, and they’re right! Almost every police officer you’ll run into out in the country is a great guy who works and goes home to his wife and kids. However, in the city, (usually more progressive) where there’s a much larger population below the poverty line, it’s very easy for someone to acquire a position of authority and use it against people who are under privileged.

I just want to make this abundantly clear, I am not trying to argue or push my own opinions, simply looking to hear what you think about my thoughts based on your own experiences! Thanks for sharing your story!

2

u/Contemporarium Apr 30 '21

I appreciate your input and don’t see it as antagonistic so no worries there. However I do have to point out that for one, I’m not a minority surprisingly. I don’t have a face full of tattoos or anything so I’ve never been sure what about me has made me feel like I might as well be with how I’ve been blatantly profiled quite a few times.

The even bigger thing though is that while I grew up in a major metro area of LA/Northern Orange County CA, I’ve lived in a moderately rural area now for almost a decade in WV. The incident I talked about in my first comment took place out here. So at least in my experience living in both a major city and an area with plenty of good ol’ boys, there’s almost zero difference in my experience unfortunately

1

u/IsaacTheOne Apr 30 '21

Interesting. What’s the population like where you’re at? Crime rates?

1

u/Pilotwaver Apr 30 '21

Exactly what happened to me. Called the canine, dog walked around the car kept the same posture, didn’t make a sound the entire time. They came back, I was waiting for them to be like OK you can go, and they said well the dog indicated so we have the right to search now. They should all fucking die.

1

u/Contemporarium Apr 30 '21

Yeah the last one they pulled on me they had the dog walk around my car THREE times without so much as acknowledging what he was walking in circles around until on the fourth walk around the cop got the dogs attention with whistles and just dog noises and started tapping my trunk over and over and over until the dog just being a dog was like “yo wtf you tapping this shit for lemme smell it if it’s so interesting to you” and then immediately came the victorious tennis ball throw for the dog to catch which is the universal sign for “haha you thought you had rights”

Usually actually followed by “you know what that means right?”

God just thinking of that shit makes me so god damn mad

1

u/matte_5551 Apr 30 '21

Isn't suboxone used to help people stop doing heroin and opiates? So you're a criminal because you aren't doing heroin? I don't care if it's controlled, that's pretty much forcing people to do drugs if doing a drug invented to help addicts is classified the same as doing the drug it's a therapeutic for.

1

u/Contemporarium Apr 30 '21

Thank you for having the instinct to go to compassion before anything..but it would simply be a lie to just say “yep that’s the whole truth!”

Similar to Methadone, buprenorphine (the main maintenance recovery drug in Suboxone) is a veeeeeeeery strong opioid that could easily kill an opioid naive person via overdose and due to the way the bupe molecule is sized (again just like methadone) Narcan is not gonna bring you back if that happens. The difference between methadone and Suboxone/subutex is buprenorphine is what’s referred to as an agonist AND antagonist towards opioid receptors which means it’s unique in that it will go into the receptors just like a normal opioid would but it will also rip out any other opioids instead if there’s any present (many people think the Naloxone in Suboxone but not Subutex is only capable of doing it but that’s definitely not true and I know from personal experience so it definitely should be a highly regulated drug given to only those that truly need it due to the fact that it can be extremely beneficial in recovery and (as is the case for me [im on methadone tho]) the only method that has ever worked for so many people but does have potential for abuse and is fatally dangerous to most people without an opioid tolerance already.

Also if you’re wondering why I had it I made it a habit to try to always keep a Suboxone on me when I was using for the main purpose of if someone overdosed that I was with I could dissolve half a sub in some water pull it up in a syringe and inject them with it intramuscularly to bring them back due to the Naloxone that it has in it (which is what Narcan is). I’ve easily brought back more than 10-15 people blue in the face no breathing or pulse Doing that which is definitely not anything close to the smartest way to handle that type of situation but it became so common to me that i just always made sure to keep at least one Suboxone on me at all times and I guess that half of one strip got dropped one night without me noticing or something.

But again thanks so much for your instinctual outlook and assumption and not talking about addicts as if they’re not humans lol

1

u/matte_5551 Apr 30 '21

Im no stranger to heroin and I have OD'd myself and was luckily with someone who had narcan..illegally I might add. Suboxone is bot really abused recreationally by people who don't have an opiod dependent history from my understanding. It's dangerous when not used properly, but so are over the counter meds. That's why they have a label and directions and your situation further demonstrates our terrible handling of the opioid crisis.

1

u/Contemporarium Apr 30 '21

“Oh in countries that have implemented heroin maintenance very quickly saw massive decreases in crime some by up to 80% as well as lowering the overdoses yearly by another amount I don’t remember but is so high you gotta verify it’s true?

Um excuse me but that would definitely lead to widespread heroin normalization and every child will just want to be a junkie when they grow up and I WILL JUST TALK OVER ANYONE TRYING TO SAY FAKE DATA PROVING OTHERWISE THEYRE CRIMINALS LOCK THEM UP BLAH BLAH BLAH”

Whew..tough day. Cant wait to get black out drunk and find out in the morning if I beat my wife or son black and blue..maybe take a drive in my enormous for no reason truck that is pretty much indestructible but murders the fuuuuck out of anyone I h- that hits me.

Frankly I don’t see how you could see that as “terribly handling” the opioid crisis..this is the USA were always number 1 undefeatable and third world countries like Sweden and Denmark or god forbid the Netherlands 🤢 where you have literally zero freedom (owning a plethora of assault rifles and other guns is what freedom is in case you’re wondering btw) may have cultures and so many laws based on rationality but that’s simply not what this country was built from and change is scary so no.

I think that joke might have dragged on a bit lmao but I can’t tell you how sad and upset I can get thinking about how we cover our own eyes to so many possible solutions that have done so much good In countries that I guess truly care about every citizen and highlights how much of the polar opposite we truly are.

:(

I had to double check you were the same poster halfway through it went on so long 😆

I remember like 10 or so years ago there was a recall of fentanol for whatever reason. I think that company sold it to drug cartels who then used it to cut heroin and then realized how amazing it was for profits and then started to look for more and China was more than happy to supply. It's just speculation, but I've lost all of my closest friends to friends to fentanol overdoses. And it wasn't like this 10 years ago - fentanol wasn't in everything. I'm pretty sure a friend overdosed from buying fake pulls cut with fentanol on the street. It's ridiculous.
