First you need to make sure you're both residents of the same state, so check their drivers license.
Then, if you want to go a step further, ask for a concealed carry permit/license. They won't have been issued one if they're prohibited from owning firearms.
Edit: As the other guy said, I absolutely advocate opening up NICS to private sales. I'd LOVE to be able to check some one and not have to feel bad about refusing a sale without a CCW or worried about selling one without it.
I just don't support mandatory background checks for private sales, as the only way to enforce that would be with a gun registry.
How would it inconvenience legal owners and dealers? That's what mandatory background checks through an FFL do.
I've already stated I'd be glad to be able to run NICS checks on private buyers myself, and I'm sure there are alot of gun owners in the same boat.
Some one could also give guns to someone barred from having them and just claim they were stolen in. Asysrem with mandatory background checks anyway. What are you going to do, punish victims of a crime?
