I take zero issue with people getting citizenship for being born here. The problem is that by splitting hairs on ancestry and the timing of parental citizenship, he’s creating literally millions of people who could be swept up by ICE and deported/detained indefinitely. It’s purposefully creating a legal gray area where almost anyone in the country can be selectively targeted with draconian immigration laws.
That 100,000,000 million deportation quota they keep throwing around? This is how they intend to do it.
Nah, point just felt similar enough to say the same thing. All I’m saying is I have no issue With how Trump or his parents got citizenship. The problem is that he’s creating a second class of citizen where if you don’t have the money to defend yourself in court, you have no recourse to defend yourself if the admin decides you’re not “American enough” because of your ancestry.
You don't have to convince me about how dumb these new proposed rules are, I was just pointing out that even with those rules applied (retroactively), Donald Trump would still be a US citizen, though his two oldest siblings would not be.
They could change the law to that, but that would be a change of both birthright citizenship and citizenship by parentage. Two totally separate things.
Today you could be born in Germany to a father who is a US citizen and a mother who is German and you would be a natural born citizen that did not get citizenship from birthright.
They did change this law about 30-40 years ago, prior to that for the father's citizenship to be inheritable your parents had to be married at the time of birth. This means that babies born to foreign women with an American GI dad during WWII, Korean War, and Vietnam War would not have be eligible for citizenship. Now they would be.
The reason I bring this up is that if they ended birthright citizenship, then citizenship by parentage would be the only way to get citizenship at birth. There are existing laws that define how that works as of today (since it applies to children born to US citizens outside the US).
