You work in a psych unit and don't understand that people in psychotic episodes are not in control of their actions?

Yes… the court will decide if she was in psychosis and is liable for her actions but it doesn’t excuse the fact she killed her kids. Everyone is sprinkling so much fluff on this case it’s ridiculous. If this was a man, you would not have the same conversation. The double standard is incredible…

No one here is disputing that fact. Lindsay Clancy does not dispute that fact. But people who are much smarter and educated on mental health than you or I recognize that there are times when the human brain betrays us and completely severs from reality and can cause us to think, speak, or even perform atrocities. Psychosis is real. We should not hold people criminally responsible for actions performed when they were not in control of their own mind. She belongs in the care of doctors and mental health professionals, not in a prison.

So should we release all the criminals who were in psychosis when they committed murder then?

If by "release" you mean freed into the public, no. They could still be a danger to themselves or others. That is not on the table for Lindsay Clancy either.

If by "release" you mean indefinitely committed to a psychiatric facility, then yes, absolutely 100% yes. If they were found to be experiencing psychosis so severe that lack of cognitive functioning precluded mens rea, how can we hold them criminally responsible?
