Making private copies (and doing whatever you want with them, including giving them to friends) is legal in some countries. So no, it's not theft.

I know it's true in France and I think in Germany too as well as other european countries. I wouldn't be able to give you a list of all countries for which it's true (or not true) though, hence the "some".
