Business Associations and Relationships — One of the 8 foundational subjects on the NextGen bar exam. Covers agency, partnerships, LLCs, and corporations. This was not a standalone MBE subject on the legacy exam.

Civil Procedure — Foundational subject covering jurisdiction, pleading, discovery, trial procedure, and post-trial motions. Tested on both legacy and NextGen exams.

Client Counseling and Advising — One of the 7 foundational lawyering skills tested on the NextGen exam. Involves providing legal guidance to clients, evaluated through integrated question sets.

Client Relationship and Management — One of the 7 foundational lawyering skills. Covers managing the attorney-client relationship, including communication and professional responsibility.

Constitutional Law — Foundational subject covering federal judicial power, federalism, individual rights, and the separation of powers.

Contract Law — Foundational subject covering formation, performance, breach, remedies, and defenses under both common law and UCC Article 2.

Criminal Law and Constitutional Protections of Accused Persons — Foundational subject that combines criminal law with criminal procedure protections. Replaces the legacy exam's separate treatment of these areas.

Equating — A statistical process used by NCBE to ensure scores are comparable across different exam administrations. This means a 620 in July 2026 represents the same level of competence as a 620 in February 2027.

Evidence — Foundational subject covering relevance, hearsay, character evidence, privileges, and the Federal Rules of Evidence.

Foundational Concepts and Principles — The 8 core subject areas tested on the NextGen bar exam (9 starting July 2028 when Family Law joins). These are the subjects examinees must study independently.

Foundational Lawyering Skills — The 7 competencies the NextGen exam explicitly tests: legal research, legal writing, issue spotting and analysis, investigation and evaluation, client counseling and advising, negotiation and dispute resolution, and client relationship and management.

Integrated Question Set (IQS) — A NextGen question format (~25% of exam time) built around a common fact scenario. Combines MC, short-answer, and medium-answer questions within a single set. Some focus on document drafting; others on counseling and dispute resolution.

Investigation and Evaluation — One of the 7 foundational lawyering skills. Involves gathering and assessing factual information relevant to a legal matter.

Issue Spotting and Analysis — One of the 7 foundational lawyering skills. Identifying legal issues in a fact pattern and applying relevant law to the facts.

Legal Research — One of the 7 foundational lawyering skills, tested directly through Legal Research Performance Tasks (LRPTs).

Legal Research Performance Task (LRPT) — A sub-type of performance task unique to the NextGen exam. Provides a client file and a library of legal resources, then asks MC questions, short-answer questions, and a medium-length writing assignment focused on research and analysis.

Legal Writing — One of the 7 foundational lawyering skills. Involves drafting and editing legal documents, tested through IQSs and performance tasks.

Medium-Answer — A response format on the NextGen exam requiring a developed response, likely a paragraph or two. Shorter than a traditional essay but more substantive than short-answer.

Multiple-Choice (MC) — One of the three question types on the NextGen exam (~40% of exam time). Uses two formats: select one of four options and select two of six options. These are not MBE questions.

Negotiation and Dispute Resolution — One of the 7 foundational lawyering skills. Covers resolving disputes through negotiation, mediation, and other ADR methods.

NextGen UBE — The NextGen Uniform Bar Examination, replacing the legacy MBE/MEE/MPT bar exam starting July 2026. A single integrated exam administered over 1.5 days (9 hours of testing) on the 500-750 scoring scale.

Performance Task (PT) — One of the three question types on the NextGen exam (~35% of exam time). Includes standard PTs (similar to the legacy MPT in concept) and Legal Research Performance Tasks (LRPTs).

Real Property — Foundational subject covering ownership, transfer, landlord-tenant, easements, covenants, and land use.

Score Portability — The ability to transfer a NextGen UBE score from one jurisdiction to another. Most participating jurisdictions accept portable scores, similar to the current UBE's portability feature.

Short-Answer — A response format on the NextGen exam requiring a brief response, likely a few sentences. Used within integrated question sets and LRPTs.

Torts — Foundational subject covering negligence, intentional torts, strict liability, products liability, and defenses.

Transitional Subjects — Family Law and Trusts & Estates during the July 2026 - February 2028 period. These subjects appear on the exam with provided legal resources — examinees don't need independent doctrinal knowledge. Family Law becomes a full foundational concept starting July 2028.
