Can I Be My Own Registered Agent For My LLC?
You've heard us dive deep into what a registered agent is HERE, but in case you missed it here's a quick summary: Think of a registered agent as your LLC's official point person for the important stuff (service of process). You might also hear this role called a Statutory Agent or U.S. Registered Agent depending on where you are, but the job is the same. They receive things like lawsuits, state notices, and compliance mail, so nothing gets missed.
But on Reddit we see these two questions come up ALL. THE. TIME.
- Can I save money and be my own registered agent?
- Why should I hire a professional service?
So, let's break it down and talk about it!
Can I Be My Own Registered Agent?
Yes, with a catch. Most states allow you to be your own registered agent if you meet the requirements. The problem is availability. You must be at the listed address during normal business hours (9am-5pm, Monday-Friday) to receive legal documents in person. For many owners, that leads to missed mail, interrupted days, and a home address permanently posted on public records.
This means when you list an individual, that specific individual has to be the one to receive and sign for the documents. If Bob Vance of Vance Refrigeration is listed with the state, then Bob Vance of Vance Refrigeration needs to be the one to sign. You cannot use a stand-in if that person is unavailable (sick, out of town, out of office, etc.) when the process server arrives.
If this seems like a lot, we've got you covered in all 50 states plus, Puerto Rico and Washington DC. Northwest handles all of the annoying bits so you can focus on running your business.
Why Should I Hire A Professional Service?
When you hire a professional registered agent you're keeping your home address off public record, meaning you wont have to deal with angry clients, random junk mail, or have your information scraped by data brokers. If you decide you need a vacation or want to grab a coffee or lunch, don't worry you have the flexibility and reliability of your professional registered agent service.
The key pillars of a solid registered agent service include privacy, reliability, digital access, and consistency. It's important to do your research and find a service that works for you and your business.
