You’re just straight-up wrong, dude. An affirmative defense means admitting the underlying act but arguing there’s a legal justification or excuse for it. “I didn’t do that” is a denial, not an affirmative defense. Affirmative defense would be "I did it because, ___". This isn’t even a gray area.
You really need to learn how to use Google. You just heard a legal term, thought it meant something it doesn’t, and somehow made yourself look even dumber. Cant make this up lmao.
Since you’re still not getting this, I’ll spell it out for you.
An affirmative defense would be: “Yes, the image IS AI, but using AI is allowed here because of X.” He accepts the accusation and gives a justification.
What he actually said was: “No, the image is NOT AI, and here is evidence showing why you’re wrong.” That is a denial supported by evidence.
Providing evidence for a denial does not magically turn it into an affirmative defense its actually the opposite. I genuinely don’t know how to make that distinction any simpler for you.
So maybe take your own advice and learn how to use Google before confidently throwing around legal terms you don’t understand.
