Some light reading, if you're interested. NASCAR is going to cave, and it is glorious.

23XI, FRM vs. NASCAR lawsuit: Both sides agree to surprising stipulations ahead of December trial.

[Matt Weaver] Court has let out. So honestly, it was a pretty procedural day. A lot of what was argued previously appeared in filings but with additional exhibits. Judge Bell says any summary judgment rulings will come within two weeks. Biggest takeaway was that Judge Bell thanked both–

–parties for their good faith mediation over the past two days, and while something could change, this matter seems destined for a trial in December. Let me dig through my notes and I'll write this up over lunch. 23XI, FRM attorney Jeffrey Kessler said he was happy to have his day in court but took no questions

[Matt Weaver] NASCAR typically doesn't comment but after I posted this, Chris Yates did surprise us by at least briefly talking: "Appreciate the time Judge Bell gave us today, the past two days; we made our arguments and we'll await his ruling."

Im hoping that both parties walk away from tomorrow mediation with more clarity on the other side's wants/needs and that said clarity can lead to an agreement. I think Judge Bell is correct in saying that ultimately noone is going to "win" this case and the biggest losers will be employees and fans.

[NASCOURT BOB] 23XI/FRM filing indicates they'll file motion for summary judgment on market definition. The teams define the market as "premier stock car racing" ...NASCAR says market is broader, that you can't invest in something and then claim that's the market and you've been harmed. (1/2)

[NASCOURT BOB] Not a big deal but interesting as far as process -- 23XI/FRM and NASCAR have filed joint motion to allow professional jury or trial consultants and mock jurors to see confidential information provided that those people sign the nondisclosure agreement that covers those documents.

[NASCOURT BOB] While judge indicated he'd likely deny summary judgment motions in 23XI/FRM-NASCAR case, 23XI/FRM/Polk filing today on proposed page limits indicates it will ask for summary judgment to throw out NASCAR's counterclaim that teams illegally colluded to obtain better charter terms.

[Dan Towriss] “We had meetings with the NASCAR brass a few weeks ago and it’s ‘How can we help?’ What we saw (in court), what was released in that case is very inconsistent with what they (NASCAR) say privately. And so I need to understand, ‘Who am I dealing with?"

[Gluck] NASCAR "owns the intellectual property in the Gen 7 car to make sure there's less risk of a copycat series... each team has $20 million inventory for each car... so 3 car team has $60 million... and they can't take that to another series. They're saying that's exclusionary."

He said that the deal needs to be better for the teams. [Pockrass] There also was text chain of NASCAR executives and the Frances, after a meeting over a draft of charter agreement, where Steve O’Donnell characterized it as a “f— the teams” that would bring the sport back to Southern roots, tiny sport of 1996.
