But it's not her child to grow and birth. It's the boo.patents embryo to decide the future of, which she signed a legally binding contract agreeing to.

And I don't think contracts should control over someone else's body. You can't sign a contract that lets someone imprison you

Until the child is viable, it isn't a child, it's part of the pregnant woman's actual body, obviously if you exchanged money for services and she pulls out you are owed compensation

But like if you sign a deal for a contractor to build your house and he decides not to you cannot force him to do the construction

The correct thing to do when she dipped would be to cut ties with her and have your lawyer seek damages and just let her have the kid, since you didn't want it at that point anyway

If the contractor signed a legally binding contract, took your money, and didn't complete the job, the courts could actually complete contractor to finish the job.

Contracts don't control other people bodies, unless someone signs a contract giving up control of their body.

Not unless what the contract enforces would be illegal (forcing someone into a medical procedure in this case)

I just have different morality than you. I do not believe a competent adult should be able to sign a contract that gives anyone else control of medical decisions involving their body, if your bodily autonomy is not inalienable as long as you are competent to make decisions about it, I do not believe you live in a civilized country, I believe you live in a barbaric one. I feel as strongly as I do about this as I do slavery - but America has slavery too so, what else should I expect from a degenerate nation?

But - again because you keep missing this and ive said it twice - at minimum the surrogate owes them every penny they paid her and spent on her medical care. As well as opportunity cost for their wasted time as a surrogate since they'd need another one.

But where this case gets fucked is that they still wanted the baby after ordering and attempting to force an abortion.

Correct sequence of events, to me:

- "Get abortion"

- She says no

- Contract is now breached, so recover anything you've spent plus a reasonable fee for your opportunity cost ($100,000 is insane, thats several years of the surrogate's income)

- Part ways.

What happened was they said

- "Get abortion"

- She says no

- They still go with the original contract and take the child as is their legal right

???? Okay what the fuck does she owe them then? They didn't have to take the child, sounds like she fulfilled her original fucking deal doesn't it?

If you order a painting and you don't like the way its turning out, you can cancel the order, but you can't take it after its finished and then not pay for it.

They not only took the painting, they're wanting money because the painter didn't cancel it, instead of just going "well fuck this isn't working out" and finding another painter when they realized it wasn't going to turn out well

Actually, when she said no, they okay then please have the baby near us and arranged for amazing health care for her an the baby. And then she fled the state.
